یکجانبه‌گرایی ایالات متحده آمریکا و تغییر و تحول در حقوق بین‌الملل

قدرت‌های بزرگ در عرصه نظام بین‌الملل دارای توانمندی‌های زیادی در زمینه‌های مختلف هستند که آنها را در موقعیت ممتازی برای فعالیت در عرصه‌های گوناگون بین‌المللی قرار داده است. حقوق بین‌الملل نیز بهعنوان مجموعه قواعد ناظر بر روابط بازیگران بین‌الملل، در دوره‌های مختلف، تحت تاثیر اقدامات و رویه قدرت‌های بزرگ قرار داشته است. در دوره مدرن که دوره زمانی بعد از 1945 را در بر می‌گیرد، قدرت‌های بزرگ، بویژه ایالات متحده امریکا به عنوان هژمون، در عرصه نظام بین‌الملل، علاوه بر توسعه حقوق بین‌الملل سنتی، در بسیاری از موارد به قواعد حقوقی جدید شکل داده‌اند. علاوه بر همکاری و رقابت قدرت‌های بزرگ، یکجانبه‌گرایی آنها نیز می‌تواند آثار زیادی بر حقوق بین‌الملل داشته باشد. هدف پژوهش حاضر بررسی و تحلیل نتایج و پیامدهایی است که یکجانبه‌گرایی امریکا بر حقوق بین‌الملل بعد از دوره زمانی 1945 داشته است. بدین لحاظ سوال این است یکجانبه‌گرایی امریکا در عرصه روابط بین‌الملل چه تاثیری بر حقوق بین‌الملل داشته است؟ در ادامه این فرضیه مطرح می‌شود که با توجه به ظرفیت و توانایی بالای هژمونی در عرصه روابط بین‌الملل، در حوزه حقوق بین‌المللی نیز عملکرد یکجانبه‌گرایانه این کشور اگرچه می‌تواند در مواردی منجر به ایجاد عرف بین‌المللی شود، ولی در عمل موجبات ضعف و بحران کارکردی این حوزه را فراهم می‌کند. پژوهش حاضر یکجانبه‌گرایی امریکا در عرصه حقوق بین‌الملل را در سه حوزه ایجاد عرف بین‌المللی، پیامدهای فرامرزی حقوق داخلی و تفسیر قواعد حقوق بین‌المللی توسط این کشور مورد بررسی قرار داده است. روش پژوهش حاضر توصیفی-تحلیلی است و گرآوری اطلاعات به شیوه کتابخانه‌ای صورت گرفته است.

great powers in the field of the international system have many capabilities in various fields, which has placed them in a privileged position to operate in various international fields. international law, as a set of rules governing the relations of international actors, has been influenced by the actions and procedures of great powers in different periods. in the modern era, which includes the period after 1945, great powers, especially the american hegemony, in addition to the development of traditional international law, have shaped new legal rules. in addition to the cooperation and competition of great powers, their unilateralism can also have many effects on international law. the purpose is to investigate the results and consequences of the american unilateralism on international law. the question is, what effect has american unilateralism in the field of international relations had on international law. this hypothesis is proposed that due to the high capacity and ability of hegemony in the field of international relations, in the field of international law although the unilateralist action of this country can lead to the creation of international custom in some cases, it actually causes weakness and functional crisis in this field. the present study examines us unilateralism in the field of international law in three areas: the creation of international custom, the cross-border implications of domestic law, and the interpretation of the rules of international law by this country. the method of the current research is descriptive-analytical and the information was collected in a library manner
