ارزیابی مسئولیت بین‌الملی دولت پاکستان در قبال اقدامات تروریستی در مرز ایران

یکی از موضوعات بسیار مهم در روابط مرزی ایران و پاکستان، نفوذ گروه‌های تروریستی به داخل مرزهای ایران و اقدامات تروریستی و ناامنی‌‌های متعدد این گروه‌ها می‌باشد. با توجه به اهمیت احراز مسئولیت بین‌المللی دولت پاکستان در قبال این ناامنی‌‌ها در مناطق مرزی ایران و پاکستان، هدف این پژوهش ارزیابی مسئولیت بین‌المللی دولت پاکستان در قبال اقدامات تروریستی در مرز ایران با توجه به قوانین، مقررات و رویه بین‌المللی می‌باشد. روش پژوهش توصیفی تحلیلی و برای جمع‌آوری اطلاعات از منابع کتابخانه‌ای و اسناد و رویه‌های قضایی معتبر بین‌المللی استفاده‌شده است. یافته‌‌های پژوهش نشان می‌دهد که امکان انتساب مسئولیت بین‌المللی دولت پاکستان به جهت «هدایت»و«پشتیبانی» از تروریست‌‌ها بسیار سخت می‌باشد؛ چراکه احراز شاخصه «کنترل موثر» دولت پاکستان بر اعمال گروه‌های تروریستی از موضوعات دشوار است. ازسوی دیگر درصورتی‌که محرز گردد دولت پاکستان از حملات تروریستی در مرز ایران آگاه بوده و قادر به جلوگیری از حمله بوده است، لکن از انجام این کار غفلت کرده و نیز از هشداردادن به ایران جهت پیشگیری از عمل تروریستی قصور ورزیده است، می‌توانیم نتیجه بگیریم دولت پاکستان مسئولیت فعالیت‌‌های گروه‌های تروریستی را برعهده‌گرفته است؛ چراکه این کشور در این صورت تعهدات بین‌المللی و هم‌چنین مصوبات شورای امنیت سازمان ملل درخصوص وظیفه دولت‌ها مبنی‌بر اینکه به‌طور آگاهانه اجازه ندهند تا از قلمروشان به‌گونه‌ای استفاده شود که حقوق و امنیت سایر کشورها به‌خطر افتد نقض نموده است.

Assessment of The Pakistani Government’s International Responsibility for Terrorist Acts on the Iranian Border

One of the important issues in the border relations between Iran and Pakistan has been the influence of terrorist groups within Iran’s borders and numerous terrorist acts and insecurities that these groups have had. Given the international responsibility of the Pakistani government for these insecurities in the border areas of Iran and Pakistan, the aim of this study is to assess the international responsibility of the Pakistani government for terrorist acts on the Iranian border in accordance with international law, regulations and procedures. The research method is descriptiveanalytical; and library resources, documents, and valid international jurisprudence have used to gather information. The findings show that it is difficult to attribute the international responsibility of the Pakistani government to directing and supporting terrorists, as it is difficult for the Pakistani government to achieve effective control over terrorist groups. On the other hand, if it is established that the Pakistani government was aware of the terrorist attacks on the Iranian border, it was also able to prevent the attack, but it neglects to do so and has failed to warn Iran to prevent terrorist acts. It can be concluded that the Pakistani government has taken responsibility for the activities of terrorist groups because it violates international obligations, as well as UN Security Council resolutions on the duty of governments to consciously prevent anyone to use their territory in a way that would jeopardize the rights and security of other countries has been violated.
