ارزیابی اثرات الحاق ایران به معاهده منشور انرژی بر ترانزیت برق

سند منشور انرژی اولین و مهم ترین معاهده بین المللی در زمینه تنظیم قوانین و مقررات بین المللی در حوزه انرژی در نظر گرفته شده است. لزوم بررسی ابعاد مختلف این سند با توجه به اینکه ایران یکی از مهم ترین و تاثیر گذار ترین کشورهای دنیا در زمینه تولید و ترانزیت انرژی می‌باشد بر کسی پوشیده نیست. این معاهده چهار موضوع اصلی را پوشش می‌دهد: ترویج سرمایه‌گذاری در انرژی توسط منابع خارجی بر اساس اعطای امتیازات داده شده به سرمایه‌گذاران داخلی و یا امتیازات ذکر شده در دولت کامله الوداد، تجارت آزاد انرژی بر اساس قوانین سازمان تجارت جهانی، آزادی ترانزیت انرژی از طریق خطوط لوله و شبکه‌های انتقال برق، برقراری یک مکانیزم خاص برای حل و فصل مناقشات بین کشورها و یا کشورها و سرمایه‌گذاران. در خصوص موضوعات مطرح شده در منشور انرژی بحث ترانزیت انرژی یکی ازمهم ترین فصول این منشور به شمار می‌رود.این مقاله، ضمن تشریح ماهیت حقوقی برق به عنوان یکی از ارکان انرژی، به تبیین الزامات حقوقی، سیاسی، فنی و اقتصادی جمهوری اسلامی ایران در بخش تجارت خارجی برق به منظور الحاق به منشور نیز می‌پردازد. با توجه به اینکه کشورهای همسایه ایران دارای نیاز فراوانی برای تامین انرژی برق خود می‌باشند، در نهایت خواهیم دید لزوم توجه به سیاست گذاری دقیق در زمینه ترانزیت انرژی برق یک امر ضروری برای ایران به شمار می‌آید.

Effects of Iran's Accession to Energy Charter Treaty on Electricity Transit

The Energy Charter has been considered as the first and most important international treaty to regulate international energy laws and regulations. Considering that Iran is one of the most important and influential countries in the world in the field of energy production and transit, the necessity of examining the different aspects of this document is not hidden to anyone. The treaty covers four main issues: the promotion of investment in energy by foreign sources based on the privileges granted to domestic investors or the privileges mentioned in the most favored nation, energy free trade in accordance with WTO rules, freedom of energy transit through pipelines and power transmission networks, and establish a special mechanism for resolving disputes between countries or countries and investors. Regarding the issues raised in the Energy Charter, the issue of energy transit is one of the most important chapters of this Charter. This article, while explaining the legal nature of electricity as one of the pillars of energy, explains the legal, political, technical and economic requirements of the Islamic Republic of Iran in the foreign trade sector of electricity in order to annex to the Charter. Considering that Iranchr('39')s neighboring countries have a great need to supply their electricity, we will finally see that paying close attention to the precise policy in the field of electricity transit is essential for Iran.
