ارزیابی مبانی جواز و ممنوعیت شبیه‌سازی درمانی در ایران و ایالات‌متحده آمریکا

روش علمی شبیه‌سازی درمانی، که داعیه درمان بسیاری از بیماری‌های صعب‌العلاج را دارد، از بدو پیدایش مورد چالش بسیاری از متفکران اخلاقی و حقوق‌دانان قرار گرفته است؛ در مقابل، موافقان این روش درمانی با توجه به فواید و مزیت‌های فراوانی که بر آن مترتب است، قائل به جواز و مشروعیت آن هستند. صرف‌نظر از مخالفت یا موافقت با شبیه‌سازی درمانی در نظام حقوقی هر کشور، تشریح اصول و مبانی موافقان و مخالفان این روش علمی، از اهمیت والاتری برخوردار است. تحلیل و ارزیابی صورت گرفته نسبت به اصول و مبانی مورد استناد موافقان و مخالفان شبیه‌سازی درمانی، مبیّن آن است که به‌دلیل یکسان‌انگاری وضعیت رویان حاصله از فرایند شبیه‌سازی درمانی با جنین یک انسان توسط مخالفان، مخالفت‌ها و استدلالات ایشان بر پایه صحیحی استوار نشده است. همچنین دانشمندان با توجه به پژوهش‌های جدید علمی، قادر شده‌اند تا با رفع دغدغه‌ها و نگرانی‌های مخالفان، به راهکارهای نوینی برای ممانعت از سوء‌استفاده از این روش درمانی دست یابند؛ پژوهش‌هایی که خود مبتنی‌بر ضرورت پیشرفت علوم و توسعه علوم پزشکی و درمانی است.

the scientific method of therapeutic cloning, which claims to cure many incurable diseases, has been challenged by many moral thinkers and lawyers since its inception; on the other hand, the supporters of this method of treatment believe in its legitimacy due to its many benefits and advantages. regardless of the opposition or agreement with therapeutic cloning in the legal system of each country, explaining the principles and bases of the supporters and opponents of this scientific method is of greater importance. the analysis and evaluation of the principles and bases cited by the proponents and opponents of therapeutic cloning shows that due to the equating of the state of the embryo resulting from the therapeutic cloning process with a human embryo by the opponents, their oppositions and arguments are not based on a correct foundation. also, according to new scientific research, scientists have been able to find new solutions to prevent the abuse of this treatment method by solving the concerns of the opponents. researches that are based on the necessity of the progress of science and the development of medical and therapeutic sciences.
