چکیده
|
شناخت دقیق حقوق افراد در یک نظام حقوقی به دلیل مسائل گوناگون ازجمله: تورم قانون و ... به راحتی امکان‌پذیر نیست. یکی از این حقوق، «حق زارعانه» است که به دلیل فقدان هرگونه نص صریح قانونی، اوصاف، کارکرد، مبنا و همچنین سرنوشت آن مبهم مانده است. همین موضوع سبب شده است تا محاکم در رسیدگی به دعاوی با این موضوع با آرای متفاوتی فصل خصومت نمایند. در این مقاله با نگاهی به مبنای واقعی حق زارعانه تلاش شده است تا ضمن تحلیل نظریات و نگاهی متفاوت به موضوع، مبنا و سرنوشت این حق در نظام حقوقی کنونی بررسی شود. حاصل آنکه، حق زارعانه یکی از حقوق زارعین صاحب «نسق» در اراضی زراعی بوده که ریشه در سنت و عرف قدیم کشاورزی جامعۀ ایران داشته است. با انجام اصلاحات ارضی حق زارعانه به «حق تملک» زمین تبدیل شده و ارتقا یافته است و در شرایط امروزی، چنین حقی دیگر موجودیت ندارد و افرادی که ادعای «تضییع و انکار» چنین حقی را در اراضی دیگران دارند، می‌بایست تنها در فرآیند مقررات «اصلاحات ارضی» و مشخصاً مادۀ واحدۀ مصوبۀ مجمع تشخیص مصلحت نظام در‌خصوص «تعیین تکلیف باقی‌ماندۀ قراء مزارع و املاک مشمول قانون اصلاحات ارضی مصوب 1370» حقوق خود را استیفا نماید.

Abstract
|
recognizing people’s rights in a legal system is not easily possible due to various issues such as law inflation and …. one of these rights is &zareaneh& due to the absence of any clear legal text, attributes, function and basis as well as its destiny. this issue has led to the courts in dealing with this issue with different views. in this article, with a view to the true basis of the right of justice, it is attempted to analyze the basis and destiny of this right in the current legal system. farmers ’ rights as one of the farmers ’ rights are the owners of the business, which is rooted in the tradition and custom of ancient agriculture in iran. by carrying out the land reform right, the right to possession of land has been transformed and upgraded, and in modern conditions, such a right has no other entity and the people who claim to && violation and denial & & claim to be entitled according land reform provisions.
