تحلیل چیستی نسبت میان صلح و عدالت

صلح و عدالت، به عنوان دو ارزش اساسی، نقش کلیدی در کیفیت، مقبولیت و موفقیت تصمیم گیری های عمومی دارند. با این حال، همانند بسیاری از دیگر مفاهیم اجتماعی و انسانی، این دو مفهوم ضرورتاً هم نشین و سازگار نیستند و احتمال تعارض و تزاحم میان آن ها وجود دارد. با فرض رد نظریه نادرست بودن دوگانه ی صلح/عدالت و پذیرش امکان تعارض میان آنها پرسش مهم این است که: تقدم با کدام یک از این دو ارزش است؟ این مقاله به روش توصیفی- تحلیلی، با بررسی نظریه های یگانگی و دوگانگی صلح و عدالت به زمینه های تعارض و تزاحم میان این دو ارزش می پردازد و استدلال می کند که به جهت کل نگر بودن صلح، در صورت تعارض و یا تزاحم آن با عدالت، اولویت با مراقبت از صلح است. همچنین عدالت برای تحقق، نیازمند توافق میان نیروهای اجتماعی است؛ امری که خود در سایه ی صلح ممکن است. مقاله همچنین به پاره ای از بازتاب های تقدم صلح بر عدالت در نظام حقوقی مانند اهمیت یافتن نهاد عفو، عدالت ترمیمی و داوری می پردازد.

an analysis of the essence of the relation between justice and peace

peace and justice as two central values, have a pivotal role in quality, acceptability and success of publicdecisions. nevertheless, they are like many other human and social concepts that are not necessarilycompatible together and consistent and a conflict between peace and justice is not impossible. given thisconflict and negating the idea that presumes peace/justice as a false dichotomy, the question is that whichone has priority over the other. adopting a descriptive- analytical method, this article examines the theoriesof unity and duality of peace and justice and studies the scops of conflict and interference between thesetwo values and argues that in case of conflict peace is preferable, because it has a holistic perspective.likewise, to achieve justice, social agreement is required. this will happen only in the light of peace. thearticle mentions some consequences of priority of peace over justice in legal system. of them is thesignificance of institutes like forgiveness, restorative justice and arbitration.
