بزه دیده شناسی ترمیمی کودکان کار با تمرکز بر تکالیف قانونی سازمان بهزیستی

یکی از اولویت‌های بزه دیده شناسی، آسیب‌های ناشی ازکارکردهای اطفال و نوجوانان، به لحاظ وضعیت فیزیولوژیکی آنان می باشد. از میان تمام اشکال سوء استفاده ها در ارتباط با این قشرحساس، موضوع کودکان کار، که برآیند ساختارهای ناکارآمد شناختی، اقتصادی و اجتماعی می باشد، مورد توجه قانونگذار دردهه نود، قرار گرفته است. اهمیت نقش کودکان کار در بروز رفتارهای ضد اجتماعی، با بهره گیری از تجارب کشور های توسعه یافته، طی بررسی های روانشناختی، همواره، دغدغه اصلی جامعه شناسان و جرم شناسان، طی سال های اخیر بوده است، لذا قانون حمایت از اطفال و نوجوانان سال 1399 برگرفته از کارکردهای حمایتی و در جهت توسعه جسمی، ذهنی و اجتماعی کودکان، تصویب و در دستور کار دستگاههای اجرایی قرارگرفته است. در این پژوهش، با استفاده از روش‌های کتابخانه‌ای و میدانی، عوامل موثر در ایجاد محیط های نامساعد، زمینه ساز جرائم برای کودکان کار، با محوریت کارکردهای سازمان بهزیستی و ارائه راهکارهای منجر به تحقق حداکثری اهداف عدالت ترمیمی مورد بررسی قرار گرفته است. از این رو تعاملات بهزیستی، در راستای شناسایی، پذیرش، حمایت، نگهداری و توانمند سازی کودکان کار در معرض وضعیت مخاطره آمیز، با هدف آماده سازی برای داشتن یک زندگی مسئولانه در جامعه ای آزاد، مورد توجه قرار گرفته است. رسالت احیاء و تکوین کودکان کار، نیازمند تعاملات فرا سازمانی و اجرای تکالیف قانونی سایر نهادهای مسئول، در آیین نامه ماده 6 قانون اخیرالذکر می باشد، که برای تحقیقات آینده پیشنهاد می گردد.

restorative victimology of working children with focus on legal obligations of welfare organization

one of the priorities of victimology is the damages by the children and adolescents' work due to theirphysiological situation. among all forms of misuse concerning these sensitive people, the subject ofworking children, which is the result of inefficient cognitive, economic, and social structures, has receivedparticular attention from the legislator, especially in the nineties. the significant role of working childrenin the occurrence of antisocial behaviors, benefitting the experiences of the developed countries, throughpsychological studies has been always the main concern of sociologists and criminologists in recent years.therefore, the law of support of children and adolescents in 2020, extracted from the supportive functionsand for the physical, mental and social development of children, has been ratified and included in the agendaof the executive organizations. in this study, using library and field methods, the effective factors in thecreation of unfavorable atmospheres, predisposing offenses for the working children, with focus on thefunctions of welfare organization and submission of solutions resulting, aiming at the realization of therestorative justice. thus, interactions of the welfare organization, for the identification, acceptance, support,protection, and empowerment of the working children subject to the risky situation, aim at preparation forhaving a responsible life in a free society, has received attention. the mission of restoration of workingchildren to normal life necessitates extra-organizational interactions and fulfillment of legal obligations ofother responsible institutions in the regulation of article 6 of the above-mentioned law, which is proposedfor future research.
