تنظیم گری آزادی بیان در فضای مجازی (مطالعه تطبیقی در حقوق ایالات متحده آمریکا، اتحادیه اروپا و ایران)

فضای مجازی به‌سرعت به ابزار کلیدی استیفای حق آزادی بیان تبدیل شده است. فضای مجازی هم حق دریافت و هم حق بیان و انتشار اطلاعات، ایده‌ها و عقاید، به صورت نوشتاری یا از طریق صدا یا ویدئو، را در یک رسانه با هم ترکیب می‌کند.فضای مجازی به موازات ایجاد دسترسی و امکان پخش حجم عظیمی از اطلاعات برای مخاطبان میلیونی تا گسترۀ همۀ افرادی که به رایانه و خط تلفن دسترسی دارند، چالش‌ها و موضوعات حقوقی جدیدی به همراه دارد که تنظیم گری صحیح و مطلوب آنها را الزامی می‌گرداند از این‌رو، در این مقاله تلاش شده است با توسل به رویکرد میانرشتهای، روشهای تنظیم‌گری آزادی بیان در دو حوزه هرزه نگاری کودکان و نفرت پراکنی را در فضای مجازی مورد بررسی و ارزیابی قرار گیرد. نتایج این تحقیق مشخص میکند روش های تنظیم گری در حال حاضر تا چه حد کارآمد است و همچنین روش موثر و کارامد برای تنظیم گری در حوزه مورد بحث چگونه باید باشد.

regulation of freedom of speech in cyberspace: a comparative study in united states, european union and iranian law

cyberspace is rapidly turning into a major tool for exercising the right to freedom of speech. cyberspaceamalgamates in the media the right to receive and the right to release information, ideas, and beliefs in theform of a written text, audio or video file. in parallel with the creation of access and the possibility ofbroadcasting a huge amount of information for millions of audiences to the extent of all people who haveaccess to a computer and a telephone line, the virtual space brings new challenges and legal issues thatrequire their correct and optimal regulation. therefore, in this article, by resorting to an interdisciplinaryapproach, it has been investigated and evaluated the methods of regulating freedom of expression in thetwo fields of child pornography and spreading hatred in cyberspace. the results of this research determinehow effective the regulation methods are currently and also how effective and efficient regulation methodsshould be in the field in question.
