جستاری بر نظام حمایتی مناسب از آشپزی و دستورپخت غذا در حقوق مالکیت فکری

امروزه آشپزی به عنوان یک آفرینه فکری و جلوه ای از هنر اشتقاقی تلقی می شود. همواره ذوق و قریحه و اشتیاق آمیزه ای از هنر آشپزی بوده است و غذاهای نوبنیاد توام با چاشنی ابتکار و خلاقیت سهمی بسزا در پیدایش رستوران‌ها و درآمدزایی آنها دارند. بدیهی است که رونق و استمرار چنین کسب و کاری مستلزم توجه به روش‌های آشپزی و دستورهای پخت به مثابه دارایی معنوی می باشد. پژوهش پیش روی می کوشد تا مصادیق مختلف حقوق مالکیت فکری را جهت حمایت از آشپزی و دستورهای پخت غذا امکان سنجی کرده و رژیم حقوقی مناسب که بتواند حمایت بایسته و شایسته به عمل آورد معرفی کند. در این رهگذر نحوی حمایت در بستر تاسیسات حقوقی همچون کپی‌رایت، حق اختراع، علامت تجاری، لباس تجاری و اسرار تجاری بررسی می شود. دستاورد ارائه‌شده در این نوشتار، کارآمدی حقوق اسرار تجاری و توجه به قراردادهای محرمانگی را در حوزه آشپزی گواهی می دهد. این مقاله نتیجه می گیرد که تسرّی نظام های حمایتی حقوق مالکیت فکری بر آشپزی و دستورهای آن و نیز الزامات چنین حفاظتی بسته به شکل حمایت بسیار متفاوت و بعضاً فاقد کارآمدی لازم است.

research on suitable legal framework to protectculinary and recipes under the intellectual property law

today, culinary is considered as an intellectual creation and manifestation of derivative art. taste, smell,and passion have always been a mixture of culinary art, and innovative dishes combined with innovationand creativity have a significant contribution to the emergence of restaurants and their income. it is obvious that the prosperity and continuity of such a business requires attention to cooking methods and recipes as intellectual property. the current paper tries to verify the different forms of intellectual property rights to support cuisine and recipes and introduce the appropriate legal regime that can provide proper andappropriate protection. in this regard, the manner of supporting is examined in the light of legal issues suchas copyright, patent, trademark, trade dress and trade secrets. the achievement presented proves theeffectiveness of trade secret rights and attention to confidentiality agreements in the field of cooking. thispaper concludes that extending of intellectual property rights on cuisine and recipes, as well as therequirements of such support, are very different depending on the form of protection and sometimes lack the necessary efficiency.
