حل اختلاف در قراردادهای هوشمند با توجه به ویژگی خوداجرایی آن‌ها

قراردادهای هوشمند از دستاوردهای جدیدی است که مورد استقبال زیادی واقع شده ولی همچنان در رابطه با ماهیت حقوقی آن‌ها اختلاف ‌نظر وجود دارد. به علاوه، با توجه به ویژگی خوداجرایی این قرارداد‌ها و وجود فلسفه‌ی حذف اشخاص ثالث، شیوه‌ی حل اختلافات ناشی در این قراردادها از مواردی است که با گسترش استفاده از این فناوری، اهمیت روزافزونی پیدا کرده است. در پژوهش حاضر، بعد از تبیین تعاریف ارائه شده از قراردادهای هوشمند و تشریح چگونگی تامین خصیصه خوداجرایی در آن‌ها در بستر بلاک‌چین، به بیان طرق حل اختلاف ممکن در این نوع از قرارداد‌ها اعم از حل اختلاف از طریق مراجعه به مراجع قضایی و روش‌های جایگزین پرداخته شد. در پایان، پس از بررسی مزایای داوری، روش فوق به عنوان روش حل اختلاف مناسب در قراردادهای هوشمند مطرح و شرایط مختص به آن‌ بیان شد و همچنین نمونه‌هایی از داوری الکترونیکی با سازوکار مختص به بستر این فناوری که افراد می‌توانند در سطح بین‌المللی به آن‌ها دسترسی داشته باشند، مورد بررسی واقع شده و روش‌های حل اختلافات آنلاین، غیرمتمرکز، منصفانه و سازگار با ساختار بلاک‌چین پیشنهاد شد.

dispute resolution in smart contracts according to their self-executing feature

despite that smart contracts are new achievements which have been widely used, there is still disagreementregarding their legal nature. moreover, considering the self-executing feature of these contracts and thephilosophy of eliminating third parties, the methods of disputes resolution have become very important dueto the increase in the use of this technology. in this research, firstly it was explained the definitions of smartcontracts and how to ensure their self-execution features in the blockchain platform, secondly it wasexpressed the possible dispute resolution methods in this type of contracts, including dispute resolutionreferring to judicial authorities and alternative methods. after considering the advantages of arbitration,finally, the above method was proposed as an appropriate dispute resolution method in smart contracts andits specific conditions were clarified. moreover it was investigated examples of electronic arbitration witha mechanism specific to this technology that people can access internationally, and it was proposed thedispute resolution methods that are online, decentralized, fair and compatible with blockchain structure.
