تاثیر ویروس کرونا بر دادرسی ‌های کیفری؛ فرصت‌ها و چالش ‌ها

در حقوق کیفری ماهوی و شکلی، به‌ویژه آیین دادرسی کیفری، هدف قانون‌گذار در تقنین و تصویب مقررات جدید، با امعان نظر به شرایط مستحدثه، تسهیل امور در فرایند کیفری است؛ به‌نحوی‌که حقوق اصحاب دعوا رعایت گردد. البته در این خصوص، با توجه به اصول حقوقی، قانون‌گذار توجه خاصی به متهم دارد تا از حقوق وی حمایت کند. در حال حاضر، نظر به همه‌گیری گستردۀ ویروس کووید 2019 و خطرات آن بر امنیت عمومی و سلامت فردی و اجتماعی شهروندان، برنامه‌ریزی و سازمان‌دهی به منظور پیشگیری از ابتلای هموطنان به این ویروس امر ضروری است. به همین خاطر، وظیفۀ همۀ قوا و دستگاه‌های اجرایی است تا اقدامات لازم و شایسته‌ای در این زمینه را معمول دارند. همه‌گیری این ویروس و نگرانی مردم از ابتلای به آن تاثیرات بسیاری را بر روند دادرسی کیفری و همچنین نحوۀ حضور اصحاب دعاوی در مجموعۀ دادگستری‌ها و پیگیری پرونده‌هایشان داشته است. به همین منظور قوه قضائیه، مسئولان و مدیران قضایی پیرامون دادرسی‌های کیفری، تدابیری اندیشیده و بخشنامه‌ها و دستورالعمل‌های ویژه‌ای را صادر کرده‌اند. نظیر بخشنامه‌ای که معاون اول قوۀ قضائیه به منظور تعویق زمان رسیدگی دادگاه‌ها تا پایان فروردین 99 خطاب به تمام واحد‌های قضایی و اداری قوه قضائیه صادر کرد. علاوه بر این، ظهور و گسترش این بیماری در کشور، فرصتی را برای سیاست‌گذاران قضایی فراهم ساخته است تا همگام با تحولات مطرح در کشورهای پیشرفته، نظام قضایی خویش را متحول کند. از جملۀ این فرصت‌ها و ظرفیت‌های قانونی می‌توان به نظارت الکترونیکی بر محکوم، دادرسی الکترونیک و سازوکارهای آن اشاره کرد.البته این بیماری، نظام قضایی را با چالش ها و خلاهایی همراه کرده است که آنها را نیز نباید از نظر دور داشت. در این پژوهش، ضمن تبیین و بررسی تاثیر بیماری کرونا بر نظام قضایی، دادرسی های کیفری و حقوقی، فرصت ها و همچنین چالش های ایجاد گردیده در این زمینه مورد بررسی قرار خواهد گرفت.

The effect of Covid19 virus on criminal proceedings; Opportunities and Challenges

In substantive and formal criminal law, especially criminal procedure, thepurpose of the legislator in legislating and approving new regulations, takinginto account the new conditions, is to facilitate matters in the criminalprocess in such a way that the rights of the litigants are respected. Of course,in this regard, according to legal principles, the legislator pays specialattention to the accused to protect his rights. At present, in view of thewidespread pandemic of the Covid19 virus and its dangers to public safetyand the personal and social health of citizens, it is necessary to plan andorganize in order to prevent compatriots from contracting the virus.Therefore, it is the duty of all forces and executive bodies to take thenecessary and appropriate measures in this regard. The outbreak of the virusand the public’s concern about it have had a profound effect on the criminalproceedings, as well as the way litigants appear in the judiciary and pursuetheir cases. To this end, the judiciary, judicial officials and managers haveconsidered measures in criminal proceedings and issued special sections andinstructions. Such as the circular issued by the First Deputy of the Judiciaryto all judicial and administrative units of the Judiciary in order to postponethe trial until the end of April 2020. In addition, the emergence and spread ofthis disease in the country have provided an opportunity for judicialpolicymakers to change their judicial system in line with the developmentsin developed countries. These legal opportunities and capacities includeelectronic surveillance of the convict, etrial and its mechanisms. Of course,this disease has accompanied the judiciary with challenges and gaps thatshould not be overlooked. In this study, while explaining and examining theimpact of Covid19 disease on the judiciary criminal and legal proceedingsopportunities as well as challenges created in this field will be examined.
