کرونا و تاثیر آن بر وضعیت زندان‌ها و زندانیان

با توجه به شیوع گستردۀ ویروس کرونا و مخاطرات پیدا و پنهان مترتب بر امنیت عمومی و سلامت فردی و اجتماعی شهروندان و تلفات جانی متعدد گزارش شده در شهرهای مختلف کشور، برنامه‌ریزی و سازمان‌دهی منابع موجود پیرامون دادرسی‌های کیفری و همچنین وضعیت زندان‌ها و زندانیان، مهم‌ترین دغدغۀ مسئولان و مدیران قضایی می‌باشد که در این راستا صدور بخشنامه‌های متعدد در این زمینه، سازوکارها و امکاناتی را در زمینۀ اجرای طرح فاصله‎گذاری اجتماعی به منظور سازمان‌دهی امور مربوط به زندانیان در شرایط بحران بیولوژیکی کنونی فراهم نموده است.از سویی دیگر ظهور و گسترش این بیماری در کشور، فرصت‌های بسیاری را در نظام قضایی ما فراهم ساخته است تا بتوانیم با استفاده از آنها، همگام با تحولات مطرح در کشورهای پیشرفته، نظام قضایی خویش را متحول سازیم. از جملۀ این ظرفیت‌های قانونی که در این دوران می‌توان از آنها استفادۀ حداکثری نمود، تمهیدات و تسهیلات شناسایی شده در «دستورالعمل ساماندهی زندانیان و کاهش جمعیت کیفری زندان‌ها»، استفاده حداکثری از نهادهای جایگزین حبس و دادرسی الکترونیک و سازوکارهای آن است. البته این بیماری با چالش‌ها و خلاهایی نیز در نظام قضایی ما همراه بوده است که آنها را نیز نباید از نظر دور داشت. در این پژوهش، ضمن تبیین و بررسی تاثیر بیماری کرونا بر وضعیت زندان‌ها و زندانیان، تمهیدات و همچنین فرصت‌های ایجاد گردیده در این زمینه موز‌د بررسی قرار گرفته است.

Coronavirus and its Effect on Prisons and Prisoners

As a result of the Covid19 pandemic and its catastrophic effects t ondifferent aspects of human life, including national health and security andpersonal and social wellbeing of people, there must be special considerationto the criminal proceedings and the situation of the prisons and the prisoners.There have been some initiatives in the form of regulations and bylaws tomanage the special conditions created by judicial authorities and correctionsystem to materialize the social distancing requirements in prisons. Besides,this disease and its fast spread created many chances for development of theIranian judiciary system along with the developed countries. Some of themeasures taken in this era are included in an executive order called&organization and moderation of prisons’ population& and some otherinitiatives like maximizing the use of parole and probation, alternativepunishments and electronic proceedings. There have been also challengesand deficiencies in our legal system which are related to this pandemic andmust be considered carefully. In this paper, analysis has been made about theeffect of covid19 pandemic on prisons and prisoners and challenges andopportunities created.
