کاوشی تحلیلی بر ابعاد حقوقی حاکم بر تدابیر مالی حکومت (حاکمیت) در زمان بحران با تاکید بر پاندمی کووید-19

شیوع کرونا در دنیا، مجالی برای دفاع مجدد از نظریۀ دولت و اقتدار در زندگی اجتماعی ایجاد نموده و باوجوداین، نقش و کارکرد دولت با توجه به کیفیت زندگی اجتماعی، متفاوت و اقداماتش موجد بار مالی خواهد بود. در این پژوهش، ابعاد حقوقی حاکم بر تدابیر مالی حکومت در زمان بحران با تاکید بر پاندمی کووید-19 مورد بررسی قرار گرفته است. تبیین و تحلیل ابعاد حقوقی حاکم بر اقدامات دولت، نیازمند پیگیری این موضوع در حقوق اساسی و حقوق مالیه عمومی است و انتخاب سناریوهای مختلف در این خصوص (به‌ویژه با توجه به نظریه «ضرورت»)، پاسخی متفاوت در استقرار قوانین و مقررات را خواهد داشت. همچنین در این مقاله دو نظام عام و استثنایی حاکم بر مخارج دولت با توجه به وقوع بحران مورد بررسی قرار گرفته است.

An Analytical Exploration of the Legal Dimensions Governing the Financial Measures of the Government (Sovereignty) in Times of Crisis with Emphasis on the Covid-19 Pandemic

The spread of Covid19 in the world has created opportunities to redefendthe theory of government and authority in the social life, and yet the role andfunction of government varies according to the quality of social life and itsactions will create financial burden. In this article, the legal aspects ofgovernment financial measures in times of crisis have been examined withemphasis on the Covid pandemic. Explaining and analyzing the legal aspectsgoverning government actions requires pursuing this issue in constitutional lawand public finance law, and choosing different scenarios in this regard(especially according to the theory of &necessity&) will have a different responsein establishing laws and regulations. Also in this article, two general andexceptional systems governing government expenditures have been examineddue to the occurrence of the crisis.
