حقوق بین‌المللی کیفری و ویروس‌های همه‌گیر: مطالعه موردی کووید-19

حقوق بین‌المللی برای صیانت از نظم عمومی بین‌المللی، بخشی از مقررات معاهده‌ای و عرفی خود را به مسئولیت کیفری فردی اختصاص داده است. ازاین‌رو، گرایش نوین حقوق بین‌المللی کیفری توسعه ‌یافته است. حقوق مربوط به مسئولیت، چه در حوزۀ مسئولیت کیفری یا غیر آن، حقوق مربوط به قواعد ثانویه است. یکی از موضوعات مهم حقوق بین‌المللی، به‌ویژه حقوق بین‌المللی بشر، «سلامت» می‌باشد. در این حوزه حق‌هایی برای افراد انسانی و به‌تبع آن تکالیفی برای دولت‌ها پیش‌بینی شده است. شیوع برخی از بیماری‌ها و ویروس‌ها، به‌ویژه کووید-19، باعث شده است تا حقوق بین‌المللی سلامت و ارتباط آن به دیگر حوزۀ حقوق بیشتر مورد توجه قرار گیرد. نوشتار حاضر به بررسی رابطه بین حقوق بین‌المللی کیفری و اشاعه و شیوع ویروس‌های همه‌گیر با تاکید بر کووید-19 پرداخته است. در این راستا، ضمن بررسی رابطۀ «سلامت و بهداشت» با «صلح و امینت بین‌المللی»، «آسایش جهانی» و «حقوق بین‌المللی بشر» تلاش شده است تا امکان قابلیت اعمال حقوق بین‌المللی کیفری در موارد نقض حق بر سلامت در اثر اشاعه یا شیوع ویروس‌های همه‌گیر بحث و بررسی شود.

International Criminal Law and Epidemic Viruses: A Case Study of Covid-19

Some parts of treaty and customary provisions of international law, forthe sake of protection of international public order, relate to individualcriminal liability. Hence, a new trend as international criminal law has beendeveloped. Rules of responsibility, whether in the area of criminalresponsibility or otherwise, are regarded as secondary ones. One of theimportant issues of international law, especially international human rightslaw, is &health&. In this regard, rights for human beings and, consequently,duties for governments are envisaged. The prevalence of some diseases andviruses, especially Covid19, has led to more attention being paid tointernational health law and its relevance to other areas of law. The presentpaper examines the relationship between international criminal law and thespread of pandemic viruses with emphasis on Covid19. Examining therelationship between &health& and &international peace and security&, &wellbeingof the world&, and &international human rights&, the authors tried todeal with the possibility of applying international criminal law in cases ofviolations of the right to health due to the spread of pandemic viruses.
