تقلب در فراورده‌های پزشکی در وضعیت بیماری دنیا گیرکرونا و ضررورت تحقق حقوق سخت در سطح بین‌المللی

تقلب در فراورده‌های پزشکی، شامل داروها و تجهیزات پزشکی، سلامت اشخاص و بهداشت عمومی را تهدید می‌کند و مبارزه با آن را موجه می‌سازد. اما مبارزۀ موثر و فراگیر با این پدیده، قبل از هرچیز نیازمند یک سند الزام‌آور بین‌المللی است که با وجود برخی تلاش‌ها تدوین آن ناکام مانده است. در سطح اروپایی، کنوانسیون شورای اروپا در مورد تقلب در فراورده‌های پزشکی و جرائم مشابه متضمن تهدید بهداشت عمومی، با تدوین چند راهبرد به مبارزه با این پدیده در سطح اروپایی کمک کرده است. ولی سند اروپایی مزبور، مصون از کاستی نیست و اکنون، به ملاحظۀ حمایت از بهداشت عمومی، با توجه به بیماری دنیاگیر کووید-19 و تداوم، تنوع و تخمین افزایش تقلب در فراورده‌های پزشکی، تلاش برای پی‌ریزی یک سند الزام‌آور جهانی و تحقق حقوق سخت در این مورد، با هدایت سازمان بهداشت جهانی و مشارکت تمامی ذی‌نفعان، می‌تواند مبارزۀ جهانی با این پدیده را به گونۀ مناسب سامان دهد و کنشگران صالح در ایران می‌توانند با پیگیری موضوع در سطح بین‌المللی، به ایجاد حقوق سخت مربوط در قامت جهانی آن مدد رسانند.

Counterfeit in Medical Products under the Situation of Coronavirus Pandemic and the Necessity for the Realization of Hard Law at International Level

Counterfeit in medical products including drugs and medical equipmentthreatens the people’s health and public health and justifies combatting it,but effective and comprehensive combat with this phenomenon beforeanything needs a binding international instrument that despite some efforts,its codification has failed. By adopting some relevant strategies, the Councilof Europe Convention on the counterfeiting of medical products and similarcrimes involving threats to public health has facilitated combatting thisphenomenon at the European level. However, the mentioned Europeaninstrument is not free of fault, and now, considering the public healthprotection given the Covid19 pandemic and the continuity, diversity, andthe predictable increase in counterfeit medical products, drafting a bindinginternational instrument and enforcement of hard laws in this regard underthe direction of WHO along with public participation of all beneficiaries, canorganize the global combat with this phenomenon properly. The competentplayers in Iran can help in the establishment of the related hard laws at aglobal level by pursuing this subject at the international arenas.
