دموکراسی زیست محیطی در رویه دادگاه اروپایی حقوق بشر ( با تاکید بر مهفوم حقوق بشر محیط زیست )

حق بر محیط زیست سالم، به عنوان حقوق مندرج در نسل سوم حقوق بشر مورد شناسایی قرار گرفته است و از جمله حق‌های مترقی و پیشرفته‌ای است که با نگاه آینده محور، به دنبال حفظ محیط زیست برای نسل‌های کنونی و آینده است. حق بر محیط زیست سالم، موضوع چندین سند و معاهده بین‌المللی بوده و به همین دلیل تعهدات دولت‌ها را در حفاظت از آن به همراه دارد. با این حال، تمامی حق‌های بشری، زمانی به کارایی می‌رسند که در رویه قضایی نیز مورد احترام قرار گیرند. بر همین اساس، این پژوهش درصدد است تا با روش توصیفیتحلیلی ، حمایت قضایی از حق بر محیط زیست سالم را در رویه دادگاه دادگاه اروپایی بررسی کند. بر اساس یافته‌های این پژوهش، دادگاه اروپایی حقوق بشر به عنوان دادگاهی منطقه‌ای بر اساس سند موسس یعنی معاهده اروپایی حقوق بشر خود را ملزم به رسیدگی و صدور رای در موارد نقض حقوق بشر از جمله حق بر محیط زیست سالم می‌داند. از سوی دیگر، مفهوم دموکراسی زیست محیطی در رویه دادگاه به رسمیت شناخته شده است و این دادگاه در آرایی چند به این مفهوم توجه کرده است. اگرچه حق بر محیط زیست سالم صراحتا در متن معاهده اروپایی، مورد اشاره قرار نگرفته است اما رویکرد دادگاه اروپایی نشان می‌دهد، این دادگاه از طرق مواد دیگر مانند تفسیر پویا از معاهده به حمایت از حق بر محیط زیست سالم می‌پردازد. این مقاله به دنبال بررسی رویه دادگاه اروپایی حقوق بشر در زمینه حمایت از حق بر محیط زیست سالم است.

Environmental democracy in the proceedings of the European Court of Human Rights(Emphasis on the concept of Environmental human rights )

The right to a healthy environment has been recognized as a right in the third generation of human rights and is one of the progressive rights that seeks to preserve the environment for present and future generations. The right to a healthy environment is the subject of several international instruments and treaties and therefore carries with it the obligations of governments to protect it. However, all human rights are effective when they are respected in the judiciary. Accordingly, this study seeks to examine the judicial protection of the right to a healthy environment in the proceedings of the European Court of Justice through a descriptiveanalytical method. Based on the findings of this study, the European Court of Human Rights, as a regional court based on the founding document, the European Convention on Human Rights, considers itself obliged to investigate and rule on cases of human rights violations. On the other hand, the concept of environmental democracy has been recognized in the proceedings of the court, and this court has paid attention to this concept in several opinions. Although the right to a healthy environment is not explicitly mentioned in the text of the European treaty, the European Court of Justice shows that the court upholds the right to a healthy environment through other materials, such as a dynamic interpretation of the treaty. This article seeks to review the case law of the European Court of Human Rights in protecting the right to a healthy environment.
