چالش های ناشی از تامین مالی هزینه های دادخواهی توسط ثالث در سیستم قضایی امریکا، انگلستان و ایران

امروزه هزینه‌های بالای دادخواهی (حق‌الوکاله وکلا، حق‌الزحمه کارشناسان و هزینه‌های دادگاه و ... ) که به عنوان چالشی در مسیر دسترسی به عدالت و دادگستری شناخته می‌شود، طرفین را بر آن داشته تا در جستجوی عدالت و حقیقت برای تامین این هزینه‌ها، به استفاده از شیوه‌های مختلف همچون تامین مالی هزینه‌های دادخواهی توسط ثالث روی آورند. در این شیوه، سرمایه‌گذار که از طرفین دعوی نیست، تامین هزینه‌های دادخواهی یک طرف دعوی را در برابر سهمی از وصولی‌های ناشی از حکم دادگاه یا سازش بر‌عهده می‌گیرد. علی‌رغم مزایایی که طرفداران این نهاد از آن سخن رانده‌اند، شناسایی چالش‌های ناشی از آن که سیستم قضایی و بازیگران این صنعت را درگیر نموده ضروری است. فقدان مقررات‌گذاری مناسب، افزایش تعداد دعاوی و بویژه دعاوی واهی، ایده‌آل و نه واقعیت بودن «توسعه دسترسی به دادگستری» به عنوان دستاورد مهم این نهاد، کالا سازی عدالت و دادگستری، تهدید یکپارچگی سیستم قضایی از جمله چالشهای این نهاد در سیستم قضایی امریکا و انگلستان هستند. در ایران مجاز بودن تامین مالی هزینه‌های دادخواهی قبل از بستر سازی، علاوه بر ایجاد برخی مشکلات فوق می‌تواند منجر به افزایش معضلات سیستم قضایی شود.

The Challenges of Third-Party Litigation Funding in Judicial System of US, UK and Iran

Nowadays, the high costs of litigation (attorney’s fees, expert’s fees and court costs, etc.), known as a challenge to access to justice, have encouraged the parties to seek justice and truth by using a variety of methods, such as thirdparty litigation funding to finance these costs. In this way, the investor, who is not originally a party to the suit, finances the party’s litigation costs in return for a share of the proceeds of the court verdict or settlement. Despite the benefits of third party litigation funding mentioned by proponents, it is essential to identify the challenges that have involved the judiciary and players in this industry. The lack of proper regulation, overall increase in litigation and particular frivolous suits, ideal rather than the reality of the &development of access to justice& as an important achievement of this entity, commoditization of justice, threat to the integrity of the judicial system, are the challenges of this entity in US and UK judicial system. In Iran, in addition to some of the above problems, authorizing the thirdparty litigation funding before preparation may lead to increase in the problems in the justice system.
