پزشکی شدن جرم و انحراف ؛ درآمدی بر تحلیل گفتمان انتقادی رویکرد بالینی به مسئله بزه‌کاری

رویکرد بالینی به جرم، مجرم، بزه‌دیده و عدالت کیفری به عنوان یک مدل سیاست جنایی نزد اغلب جرم‌شناسان جایگاه بی‌بدیل و خدشه ناپذیری دارد. در ادبیات جرم‌شناختی گذشته و امروز، رویکرد بالینی مترادف با مفاهیم و موازین حقوق بشری همچون پیشگیری از تکرار جرم و کژروی‌های اجتماعی، رعایت کرامت انسانی بز‌ه کاران، حمایت از حقوق بزه‌دیدگان، بازپروری محکومان کیفری، دادرسی عادلانه، کارکرد اصلاحی کیفر و هم سویی منافع بز‌‌ه کار با مصالح حمایتی از جامعه بازشناخته شده است. این مقاله ضمن به چالش کشیدن رویکرد بالینی در حوزه بزه‌ کاری از طریق بازتعریف آن با استفاده از مفهوم پزشکی شدن ، می‌کوشد نشان دهد فرآیند پزشکی‌شدن جرم و انحراف کجا و چه زمانی، توسط چه کسانی ، با چه طریقی و قواعدی و با چه طرح ادعاهایی انجام شده یا می‌شود و این فرآیند چه نتایج یا بازدهی را برای حرفه پزشکی، بزه کاران، بزه‌دیدگان، جرم شناسان، سیاست‌گذاران جنایی، دولت‌ها و مردم که جملگی کارگزاران آن می‌باشند، به ارمغان آورده یا خواهد آورد. نتیجه‌ی فرآیند پزشکی‌سازی ، قدرت اداره عرصه‌ی جرم‌شناسی و سیاست جنایی به نفع گروه ادعاساز است. پاداشی که تا به امروز نصیب حرفه پزشکی شده است.

Medicalization of Crime and Deviance; An Introduction to Critical Discourse Analysis of Clinical Approach to Delinquency problem

Abstract: A clinical approach to crime, offender, victim, and criminal justice as a model of criminal policy has a unique and impeccable position before most of the criminologists. In the past and present criminology literature, the clinical approach is recognized to have the same meaning as the concepts and standards of human rights such as preventing recidivism and social deviations, observing the human dignity of offenders, supporting the victims’ rights, rehabilitation of criminal convicts, fair trial,corrective function of punishment and aligning the offender’s interests with the supportive benefits of the society.While challenging the clinical approach in delinquency field through redefining it, using medicalization concept, this essay tries to show when, where, by whom, with which methods and principles and through what claimsmaking, the process of medicalization of crime and deviance has been done, and what results or outcomes have been or will be brought by this process for the medical profession, offenders, victims, criminologists, those who lay down criminal policies, the government and the people, who all are the claims makers.The result of medicalization process is the power to manage the criminology and criminal policy grounds in the favor of claimmaking group – the reward which the medical profession has been benefited so far.
