تغییر غیر‌رسمی قانون اساسی یکی از موضوعات مطرح در تئوری حقوق اساسی است، که ذیل بحث اصلاح قانون اساسی مطرح می‌شود. در قوانین اساسی راه‌هایی برای اصلاح و بازنگری قانون اساسی پیش‌بینی می‌شود که در حقوق اساسی به عنوان راه‌های اصلاح رسمی قانون اساسی شناخته می‌شوند. اما قانون اساسی از طرق دیگری نیز تغییر می‌کند که به آن تغییر غیر‌رسمی قانون اساسی گفته می‌شود. در این شیوه متن قانون اساسی ثابت می‌ماند، اما محتوا و معنای آن تغییر می‌یابد. این شیوه در قوانین اساسی وجود دارد اما به راحتی قابل تشخیص نمی باشد. در میان شیوه‌های غیر‌رسمی تغییر قانون اساسی تفسیر قانون اساسی و رویه‌های اساسی از دیگر شیوه‌ها معروف‌تر هستند. این تحقیق از نوع تحلیلی و توصیفی می‌باشد و در آن کوشش شده است به این سوال پاسخ داده شود که دلایل تغییر غیر‌رسمی، رویکردها و شیوه‌های تغییر غیر‌رسمی و نیز حد و مرزهای تغییر غیر‌رسمی قانون اساسی چه می‌باشد و از این طریق به دنبال مشخص کردن مبانی و روش‌های تغییر غیر‌رسمی قانون اساسی است.

In constitution there are ways to reform and revise the constitution that recognized as formal constitutional change. But the constitution changes in other ways, which is called the Informal constitutional change. In this way the constitutional text remains constant, but its content and meaning change. This method exists in the constitutions, but it is not easily detected. Among the Informal constitutional change the interpretation of the constitution and the constitutional convention are more famous than other methods. In this paper attempts to examine the foundation and reasons for Informal constitutional change, approaches and practices, as well as the limits of Informal constitutional change. The research is analytical and descriptive, and seeks to identify the foundation and methods of informal change in the constitutions.
