نسبت حق تعیین سرنوشت و دموکراسی از منظر حقوق بین الملل

در اسناد بین‌المللی مردم از حق تعیین سرنوشت برخوردارند و به موجب آن می‌توانند آزادانه وضعیت سیاسی خود را تعیین و توسعه اقتصادی، اجتماعی و فرهنگی خود را پیگیری نمایند. حق مردم برای تعیین شکل سازمان اجتماعی‌شان، منطقاً مبتنی بر قسمت اول تعریف مزبور است؛ یعنی حق حکومت کردن برخود. لیکن در مورد این‌که آیا حق تعیین سرنوشت شامل حق داشتن یک حکومت دموکراتیک هم هست یا خیر اختلاف نظرهایی وجود دارد.نسبت حق تعیین سرنوشت ملت‌ها در حقوق بین‌الملل به عنوان اصل پشتیبان و حافظ حقوق بشر، با دموکراسی، به دلیل تنوع زیاد حقوق و آزادی های بشر به عنوان ارزش‌های مبنایی حق تعیین سرنوشت، نسبتی پیچیده و چندوجهی است. حقوق مدنی و سیاسی جزء « جدایی‌ناپذیر و ضروری » مفهوم دموکراسی هستند لذا تعیین سرنوشت سیاسی در چارچوب حکومتی دموکراتیک به خوبی تامین می‌گردد. رابطه تعیین سرنوشت اقتصادی و اجتماعی با دموکراسی به مانند تعیین سرنوشت سیاسی، ذاتی و لاینفک نیست؛ حقوق اقتصادی و اجتماعی به دلیل نقش آفرینی در فعلیت یافتن حقوق سیاسی به نحوی غیر مستقیم در دایره مفهوم دموکراسی قرار می‌گیرند. لذا حق بر توسعه اقتصادی و اجتماعی در چارچوب حکومت دموکراتیک به عنوان پیش شرط لازم بر ای تعیین سرنوشت سیاسی و مدنی حاصل می‌گردد. اقلیت‌ها وگروههای فرهنگی ضمن شناسایی و احترام به فرهنگ متمایز آنها در نهادهای تقنینی، اجرایی و قضایی در رابطه با دموکراسی مانند سایر افراد آن جامعه حاملان یکسان و تمایز ناپذیر حقوق و آزادی ها تلقی می‌شوند، نه اعضای جوامع فرهنگی که باید از حقوق متمایز فرهنگی برخوردار باشند.

the Relationship Self-Determination Right and Democracy from the Perspective of International Law

Abstract:There is a relation between SelfDetermination right and democracy international law, as a supportive principle that protects human rights. This relation is a complicated and multilateral one because of the large diversity of human rights. Civil and politic rights are inseparable and necessary parts of the concept of democracy, so politic and civil self – determination will be provided within the framework of a democratic government structure. The relation between social and economic self – determination and democracy is not inseparable, like that for civil and politic self – determination. Because of having a role in actualizing civil and politic rights, economic and social rights are directly included in the range of democracy concept. So self determination and social and economic development are provided within the framework of a democracy government as a necessary pre – requisite for political and civil self – determination. People of cultural communities, while whose distinct culture is recognized and respected in legislative, administrative and … institutions, are considered to have the same and nondistinct politic, civil, economic, social and cultural rights as the citizens of that society. They are regarded as the members of cultural communities who should have distinct culture rights
