چکیده
|
اﺻﻞ ﺑﺮ اﻳﻦ اﺳﺖ ﻛﻪ ﻫﻴﺌﺖ ﻫﺎی رﺳﻴﺪﮔﻲ ﺑﻪ ﺗﺨﻠﻔﺎت اداری ﺑﻪ ﺗﺨﻠﻒ ارﺗﻜﺎﺑﻲ ﻛﺎرﻣﻨﺪ در زﻣﺎن اﺷﺘﻐﺎل رﺳﻴﺪﮔﻲ و در ﺻﻮرت اﺣﺮاز وﻗﻮع ﺗﺨﻠﻒ، ﻣﺠﺎزات ﻣﻘﺮر در ﻗﺎﻧﻮن رﺳﻴﺪﮔﻲ ﺑﻪ ﺗﺨﻠﻔﺎت اداری را درﺑﺎره او اﻋﻤﺎل ﻧﻤﺎﻳﻨﺪ. اﻣﺎ در ﻣﻮارد ی ﺑﻪ واﺳطه ﺑﺮوز ﺑﺮﺧﻲ ﻣﻮاﻧﻊ، رﺳﻴﺪﮔﻲ ﺑﻪ ﺗﺨﻠﻒ اداری ﻳﺎ اﻋﻤﺎل ﻣﺠﺎزات ﻛﺎرﻣﻨﺪ ﻣﺤﻜﻮم ﻋﻠﻴﻪ ﻣﻨﺘفی ﻣﻲ ﺷﻮد .. ﺑﺎزﻧﺸﺴﺘﻪ ﺷﺪن ﻛﺎرﻣﻨﺪ ﻗﺒﻞ از ﺷﺮوع ﻳﺎ در ﺟﺮﻳﺎن رﺳﻴﺪﮔﻲ و ﭘﻴﺶ از ﺻﺪور رای، ﻣﻮﺟﺐ ﺗﻮﻗﻒ رﺳﻴﺪﮔﻲ و ﭘﺲ از ﺻﺪور رای ﻣﺤﻜﻮﻣﻴﺖ ﻧﻴﺰ ﻣﺎﻧﻊ اﻋﻤﺎل ﻣﺠﺎزات ﻣﻲ ﺷﻮد. ﺑﺎ اﻳﻦ ﺣﺎل، در ﻣﻮاردی ﺑﺎزﻧﺸﺴﺘﮕﻲ ﻛﺎرﻣﻨﺪ، ﺗﻮﻗﻒ رﺳﻴﺪﮔﻲ ﺑﻪ ﺗﺨﻠﻒ ﻳﺎ اﺟﺮا ﻧﺸﺪن ﻣﺠﺎزات اداری را در ﭘﻲ ﻧﺪارد. ﻫﻤﭽﻨﻴﻦ در ﺻﻮرﺗﻲ ﻛﻪ ﺗﺨﻠﻒ واﺟﺪ وﺻﻒ ﻣﺠﺮﻣﺎﻧﻪ ﻛﺎرﻣﻨﺪ، رﻳﺸﻪ در زﻣﺎن اﺷﺘﻐﺎل داﺷﺘﻪ، ﻛﺎرﻣﻨﺪ ﭘﺲ از ﺑﺎزﻧﺸﺴﺘﮕﻲ، در دادﮔﺎه ﻣﺤﻜﻮﻣﻴﺖ ﻛﻴﻔﺮی ﭘﻴﺪا ﻛﻨﺪ ﻳﺎ اﻳﻨﻜﻪ ﭘﺲ از ﺑﺎزﻧﺸﺴﺘﮕﻲ ﻣﺮﺗﻜﺐ اﻋﻤﺎﻟﻲ ﺷﻮد ﻛﻪ ﺑﻪ ﻣﻮﺟﺐ ﻗﺎﻧﻮن رﺳﻴﺪﮔﻲ ﺑﻪ ﺗﺨﻠﻔﺎت اداری ﻗﺎﺑﻞ ﺗﻌﻘﻴﺐ ﺑﺎﺷﺪ ، در ﭼﻨﻴﻦ وﺿﻌﻴﺘﻲ اﻣﻜﺎن رﺳﻴﺪﮔﻲ ﺑﻪ ﺗﺨﻠﻔﺎت ﻛﺎرﻣﻨﺪان ﺑﺎزﻧﺸﺴﺘﻪ و ﻧﻴﺰ اﻣﻜﺎن اﺟﺮای ﻣﺠﺎزات ﻫﺎی اداری درﺑﺎره آﻧﺎن ﺗﺤﺖ ﺷﺮاﻳﻄﻲ وﺟﻮد دارد و ﺑﺎزﻧﺸﺴﺘﮕﻲ ﻣﻮﺟﺐ ﺗﻮﻗﻒ رﺳﻴﺪﮔﻲ و اﻋﻤﺎل ﻣﺠﺎزات ﻧﻴﺴﺖ . در اﻳﻦ ﻧﻮﺷﺘﺎر ﺗﺄﺛﻴﺮ ﺑﺎزﻧﺸﺴﺘﮕﻲ در رﺳﻴﺪﮔﻲ ﺑﻪ ﺗﺨﻠﻔﺎت اداری و اﺟﺮای ﻣﺠﺎزات ﻫﺎی اداری و ﻣﻮﺿﻮﻋﺎت ﻣﺮﺗﺒﻂ ﺑﺎ آﻧﻬﺎ ﻣﻮرد ﻣﻄﺎﻟﻌﻪ ﻗﺮار ﻣﻲ ﮔﻴﺮد.

Abstract
|
the purpose of the 1951 geneva convention on the status of refugees is to provide international protection to those who have been deprived from national protection against persecution. international protection is the protection granted by any country other than the country of nationality or the country of residence (in the case of those not having a nationality). this protection is granted when the conditions set forth in 1951 convention are met. moreover, the convention includes provisions to ensure that the refugee protection regime would not provide a cover for persons involved in serious not political crimes, crimes against humanity, crimes against peace, war crimes or acts contrary to the purposes and principles of the united nations. in considering the status of terrorist criminals in the refugee convention, this article seeks to show that the perpetrators of terrorist crimes are covered by these regulations and could not benefit from refugee status.
