ساختارهای حمایتی از تولیدکنندگان محتوا، در دستورالعمل بازار منفرد دیجیتالی اروپا و رویکرد لایحه جدید مالکیت های ادبی، هنری و حقوق مرتبط ایران نسبت به آنها

دستورالعمل اروپایی حقوق مولف در بازار یکپارچهِ دیجیتالی مصوب سال 2019 در حال حاضر آخرین دستورالعمل این اتحادیه در حوزه مالکیت فکری است. این دستورالعمل از یک سو در جهت ارائه حمایت بیشتر از تولید‌کنندگان محتوا و از سوی دیگر در جهت ایجاد امکان دسترسی گسترده تر به آثار در محیط الکترونیک، طراحی و ارائه گردیده است. در این دستورالعمل سه ساختارِ حمایت از آثار خارج از چرخه تجاری، امکان تعدیل قضائی قراردادهای بهره‌برداری و ارائه حقوق مرتبط به خبرگزاری‌ها در محیط الکترونیک قابل توجه و شناسائی است. با مطالعه تطبیقی نحوه عملکرد این ساختارها با ضوابط لایحه جدید ایران در حقوق مالکیت ادبی و هنری، قابل استنباط است که ارائه حمایت‌های مشابه در مورد آثار خارج از چرخه تجاری با بکارگیری پیشنهاداتی امکان‌پذیر است و همچنین ارائه حمایت‌های قراردادیی به غیر از تعدیل قضائی قراردادها در لایحه جدید ایران برای پدیدآورندگان آثار در نظر گرفته شده، اما برپایه ضوابط آن لایحه خبرگزاری‌ها دارای حقوق مرتبط نخواهند بود و این امری است که می‌تواند مورد بحث و گفتگو باشد.
