تاثیر سازمان ملل متحد در توسعه جایگاه حقوقی بین‌المللی سازمان‌های غیردولتی

دولت‌ها‌ به عنوان تابع اصلی حقوق بین‌الملل در حوزه هنجارسازی و تبعیت از قواعد حقوقی بین‌المللی جایگاه منحصر به فرد دارند؛ تشکیل سازمان‌های بین‌المللی و متعاقب آن پیدایش بازیگران غیردولتی موجب تحولات شگرفی گردید. از این میان سازمان‌های غیر دولتی سهم بیشتری از نقش‌آفرینی را نصیب خود کرده‌اند. سازمان ملل متحد با دو رویکرد قاعده‌مند کردن و بهره‌برداری تخصصی از این بازیگران، نقش بالایی در رشد و توسعه این بازیگران داشته است. نقش غیررسمی این سازمان‌ها گسترش یافته است. مجمع عمومی و شورای امنیت فراتر از اسناد ملل متحد، که مشورت با سازمان‌های غیردولتی را مختص اکوسوک می‌داند، از مشورت این سازمان‌ها بهره می‌برند. برخی از نهادهای بین‌المللی مانند شورای اروپا و سازمان کشورهای آمریکایی، کارایی این بازیگران را ارتقاء داده و برای آنها حق رای و حق داشتن نماینده همتراز در مجامع خود را پیش‌بینی نموده‌اند. سازوکار تعامل اکوسوک با سازمان‌های غیردولتی منتج به نظام‌مند شدن همکاری‌ها و رشد کمی و کیفی سازمان‌های غیر دولتی شده؛ اما در عین حال بالندگی سازمان‌های غیر دولتی غیر مستقل و طرفدار دولت را در پی داشته است. تطبیق این سازوکار با اقتضائات کنونی جامعه مدنی جهانی ضرورت دارد.

states still are the major subjects of international law in normalization and adherence to the international law rules.the formation of international organizations and following that the emergence and growth of nonstate actors brought about tremendous changes. meanwhile, ngos have taken a larger share of the role. the united nations with two approaches, legitimacy and professional utilization have played a major role in the official development of these actors. the informal role of ngos also expanded. the general assembly and the security council benefit from the consultation of these organizations beyond the un documents, which limited the consultation with ngos for ecosoc. some international bodies, such as the council of europe and the organization of american states, have promoted the skill of these actors by providing a participatory status beyond the consultative status, they have the right to vote and equal representation rights in their assemblies. the mechanism of interaction of ecosoc with ngos has led to systematic cooperation and the quantitative and qualitative growth of ngos, but at the same time it has led to the rise of nonindependent and progovernment ngos. the review and adoption of this mechanism is necessary in the current context of global civil society.
