کمیسیون اصل نود یا سازمان بازرسی کل کشور؟ مقایسه با نهاد آمبودزمان (با تاکید بر آمبودزمان پارلمانی انگلستان)

نهاد آمبودزمان در نظام‌های مدرن حقوقی واجد خصلتی غیرقضایی است که به عنوان یکی از ابزارهای نوین نظارتی بر فعالیت حکومت شناخته شده و کارکرد اصلیِ خویش را معطوف به دفاع از حقوق افراد کرده است. برخی از ویژگی‌های حاکم بر این نهادها که در اکثر نظام‌های حقوقی مشترکند، در قیاس با کمیسیون اصل نود و سازمان بازرسی کل کشور قابل تامل‌ به نظر می‌رسند. مسائلی از قبیل حیطۀ صلاحیتیِ گسترده در نظارت بر سازمان‌ها و مقام‌های عمومی، گزارش‌دهی، اطلاع‌رسانی، فرآیند غیرقضایی و استقلال از حیث کارکردی، شخصی، تشکیلاتی، سازمانی و بودجه‌ای، بخشی از این ویژگی‌های حداقلی‌اند که مقالۀ حاضر با رویکردی تطبیقی نشان می‌دهد کمیسیون اصل نود با عنایت به تمام جوانب فوق در قیاس با سازمان بازرسی، وجوه اشتراک بیشتری با نهادهای آمبودزمان مدرن دارد. نتایج حاصل از این تحقیق می‌تواند به رفع کاستی‌ها در سازمان بازرسی، ارتقای ویژگی‌ها در کمیسیون اصل نود و رفع صلاحیت‌های موازی کمک کند

commission of article 90 or state inspection organization? comparison of two ombudsman institutions, with emphasis on parliamentary ombudsman of england

in modern legal systems, ombudsman institution enjoys a nonjudicial characteristic which is recognized as a modern supervision tool of the activities of the government, with its main function being focused on defending the rights of individuals. some of the characteristics governing these institutions, shared by most legal systems, seem noteworthy compared to commission of article 90 and state inspection organization. such issues as extensive range of competence in supervision of organizations, public authorities, reporting, informing, nonjudicial procedure and functional, individual, organizational and budget independence are some of these minimal characteristics, and employing a comparative approach, the present study demonstrates that considering all the issues mentioned above, compared to state inspection organization, article 90 commission has more in common with modern ombudsman institutions. the results of this study can be used in elimination of the shortcomings in state inspection organization, enhancement of the characteristics of article 90 commission as well as omission of parallel competences.
