مفهوم‌شناسی نکره در اصول فقه و کاربست فقهی آن

واژۀ نکره در گفتمان اصولی دارای چهار شناسه است و عالمان دانش اصول فقه سه انگارۀ عمده دربارۀ مفهوم آن دارند: برخی معتقدند مفهوم آن پیوسته کلی است؛ برخی ایدۀ جزئیت را ابراز نموده‌اند؛ بعضی دیگر نیز نظریۀ تفصیل را برگزیده‌اند و بر این باورند که اگر در سیاق اِخبار واقع شود، معنای آن جزئی است و اگر در سیاق امر قرار گیرد، مفهومش کلی خواهد بود. از سوی دیگر، کاربستی فقهی دربارۀ نزاع در مفهوم‌شناسی این نهاد اصولی ارائه نشده و گاه این نهاد را فاقدِ آن دانسته‌اند. از این رو، نگارنده درصدد است دیدگاه‌های مطرح‌شده را تبیین و با نقد دیدگاه‌های رقیب، نظریۀ برگزیدۀ خود را مبرهن کند؛ در ادامه، می‌کوشد نظریۀ صاحب فصول; را روشن کند؛ آنگاه مقصود مشهور عالمان اصولی از «فرد مردَّد» را تشریح می‌نماید؛ سپس ناصوابی تعبیر به «تنکیر» را نیز در مورد تنوین امثال واژۀ «رجل» مستدل می‌کند؛ در پایان، کاربست فقهی این بحث را ارائه و تحلیل می‌نماید.

Semantics of indefinite noun in the science of jurisprudential principles and its jurisprudential function

The word of indefinite noun has four identifiers in the discourse of the science of jurisprudential  principles (Ilm alusul alfiqh), and there are three main concepts in its sense  which are stated by the Ulam`. Some believe that its concept is always general, and others have expressed the idea of its particularity and some others have selected the intermediate theory; the latter group believe that if infinite noun occurs in the context of declarative sentence, its meaning is particular, and if it is located in the form of imperative statement, its meaning will be general. On the other hand, on the controversy in  semantics of this institution in this science, a jurisprudential function has not been provided, and sometimes it was believed that it has no the mentioned function. Therefore, with explaining all the theories and criticizing the opponent ideas, the author is seeking to making his selected theory clear. In the following, the author will clarify Saheb alfosul`s theory, and describe the famous intention of the usuli scholars concerning   "farde moraddad (doubted meaning)" , and  justify incorrectness of the term "tankir (indefinitness)" as to tanvin of the words such as term "rajolon (on male)", and finally provide and analyze the jurisprudential function of the discussion.
