چکیده
|
آسیب رساندن به تمامیت جسمانی یا معنوی اشخاص، در شرایط خاصی، پیامدهای مدنی و گاه کیفری میتواند درپی داشته باشد. امروزه با تحولات علمی، مصادیق تازهای از این نوع خسارتها آشکار شده که در گذشته وجود نداشته است؛ یکی از این مصادیق، آلوده کردن دیگری با خون آلوده است. هماکنون بسیاری از خطرناکترین و مهلکترین بیماریها با این روش منتقل میشوند. نظربهاینکه گونههایی از این موضوع، جنبههای کیفری و جرمشناختی دارند، این نوشتار با رویکرد کیفری تدوین شده است. بنابراین، پرسش اصلی مقاله این است: احکام تکلیفی و وضعی، و نیز حدود مسئولیت کیفری فرد انتقالدهنده چیست؟ براساس دستاوردهای این تحقیق، انتقال عمدی خون آلوده به خود یا دیگری، بدون غرض عقلایی، حرام است. ازنظر مسئولیت کیفری نیز چنانچه این انتقال به آسیب و فوت انتقالگیرنده منجر شود، مرتکب، مستحق مجازاتی است که براساس شرایط، متفاوت خواهد بود؛ درحالیکه انتقال غیرعمدی، تنها مستلزم پرداخت خسارت (دیه یا ارش و هزینههای درمان) است.

A deliberation on transfusing contaminated blood in the Islamic Criminal Jurisprudence (Feqh)

Abstract
|
Under certain conditions, injuring a person`s physical and spiritual entirety can cause some civil and criminal consequences. Nowadays, some new examples of these such damages which did not exist in the past, have been revealed by the scientific developments. Contaminating blood is one of them that is transferring many of the most dangerous and the most fatal diseases to others now. Considering that some forms of this subject have criminal and criminological aspects, the criminal feature of this subject is to be taken an account in this paper. The main question of this paper is: what are the obligatory and conventional orders, and the limits of a transferor`s criminal liability? According to the achievements of the research, transfusing contaminated blood into oneself or another without any reasonable motive, and deliberately, is forbidden. Where, in accordance with the criminal responsibility, this transfer is resulted to injury or death of another, its perpetrator is entitled to punishment which has different conditions. But its involuntary transfer is only resulted into compensation (diyah, arsh and cure costs). This paper is written with a descriptiveanalytical method and a current jurisprudential one.
