چکیده
|
اعتبار یا عدم اعتبار خبر واحد در بحث دماء، موضوع مقاله حاضر را تشکیل می‌دهد. اهمیت بحث از آنجا نشئت می‌گیرد که از یک‌سو، داب شارع مقدس اسلام مبنی بر لزوم احتیاط تام در مسئله دماء جزء مسلّمات فقهی است و از دیگرسوی، در فتاوای فقیهان برخی از مصادیق مهدورالدم که مصداق اتم بحث دماء را تشکیل می‌دهد، با اخبار آحاد ثابت می‌شوند. ازاین‌رو این سوال مطرح می‌شود که محدوده اعتبار خبر واحد تا چه میزان است و آیا ادله مثبت اعتبار اخبار آحاد تا این اندازه از شمولیت و گستردگی برخوردار هستند که بحث خطیر دماء را نیز دربرگیرند؟ پاسخ به این پرسش نگارندگان را به تامل و استقصای فراگیر در ادله کشانده است. نوشتار حاضر در جهت نیل به این مهم به روشی توصیفیتحلیلی و با نگاهی مسئله‌محورانه، قول به عدم اکتفا به اخبار آحاد در مسئله دماء را برگزیده است. استناد به سیره و طریقه عقلا، لزوم احتیاط موکد در مسئله دم و توجه دادن به سازوکارهای فقه مقاصدی، بخشی از مستندات مختار نگارنده را تشکیل می‌دهند.

Criticizing the Theory of Authenticity of SingleNarrator Ḥadīth Regarding Human Life

Abstract
|
The importance of the authenticity of singlenarrator ḥadīth, or it's nonauthenticity, regarding "human life" is due to two points: first, the behavior of the divine about the necessity of the observation of precaution regarding "human life", which is one of the given principles of Sharī'ah, and second: the fact that the jurists' opinions in some cases of the unprotected (outlaw) which are the most explicit case in "human life" issue – are totally based upon the singlenarrator tradition. Therefore, it is very vital to discuss authenticity scopes of the singlenarrator tradition and see if it is backed by any comprehensive argument so that could embrace "human life" momentous issue. Answering this question compelled the authors to make a deep reflection and immense investigation through the pertinent arguments. This paper, through an analyticaldescriptive method and along with a problemoriented approach comes to this result that singlenarrator traditions are not reliable where "human life" concerns. Invoking to the sanes' conduct, necessity of taking heed regarding "human life", and observing the mechanism of the maqāṣidbased (objectivesbased) fiqh, are parts of the chosen evidences of the authors.
