دخالت حاکم در تولیت و نظارت بر موقوفات

استقلال وقف و حرمت دخالت غیر‌متولی و ناظر منصوص در امور موقوفه، اصلی پذیرفته‌شده در فقه است. برای جلوگیری از حیف و میل فراوان موقوفات لازم است دولت اسلامی بر اساس مبانی حسبه و ولایت فقیه در اداره و نظارت بر موقوفات دخالت کند. جمع میان ضرورت دخالت دولت اسلامی در امور مربوط به موقوفات و حفظ استقلال وقف، پرسش‌های متعددی پدید آورده است که این نوشتار در صدد پاسخ به آنهاست. نویسنده کوشیده است با تفکیک و تبیین ابعاد مختلف این دخالت در حوزه اداره و نظارت استطلاعی و استصوابی در فروض علم یا شک به قصور یا تقصیر متصدیان مال موقوفه به این پرسش‌ها پاسخ دهد.

The interference of a governor in administrating and controlling the pious endowments

The independence of endowment  and the prohibited interference of whom is not the administrator and the designated controller of endowment affairs, are the acceptable principles in the Islamic jurisprudence. In order to prevent from misappropriating the endowments, an Islamic state is required to intervene into the administration and control of them according to the foundations of hesba (nonlitigious affairs) and the guardianship of a competent jurist. Accepting both the necessity of the Islamic state`s intervention in the endowment affairs and protecting their independence has created lots of questions that this article is seeking to reply to them.The author has tried to answer to the mentioned questions by separating and verifying the different aspects of the interferences such as administration, and discretionary and informative control based on two suppositions: a definite fault or failure, or doubtful ones to the administrators of the pious endowments.
