فرضیه‌ای دربارۀ حمل روایات بر تقیه از منظر شیخ طوسی

از روش‌های متداول فقهای شیعه هنگام مواجهه با روایات متعارض، حمل روایات بر تقیه بوده است؛ امّا ضوابط این حمل، در دوره‎های مختلف، تغییرات مهمی کرده است. از جمله مهم‌ترین دوره‎ها، دورۀ شیخ طوسی در قرن پنجم است که برای نخستین بار انبوهی از روایات، بر تقیه حمل شدند. این پژوهش به بررسی نسبت این دوره‎ با دورۀ فقهای متقدم قبل از قرن پنجم می‌پردازد و در صدد کشف علت اصلی تفاوت میان این دو دوره و چرایی پیشآمد این انفراد توسط شیخ است. آیا کثرت وجود این حمل در آثار شیخ نسبت به قدما، صرفاً ناشی از تفاوت روشی او در تالیف کتب روایی و فقهی بوده است و یا این‌که علت این امر، وجود اختلاف مبنایی میان او و قدما بوده است؟ با بررسی آثار روایی و فقهی هر دو دوره، مشخص می‌شود که میان شیخ و قدما اختلافات مبنایی جدی‌ای وجود داشته و مسئله صرفاً تفاوت روشی نبوده است.

an assumption about the consideration of Taqiyyah by Shaikh Tusi

One of most prevalent methods of Shiite jurists toward contradictory traditions has been to consider them as Taqiyya. However, the instructions of this method had serious development during different periods, which one of most important of them, has been the periods of Shaikh Tousi in the fifth century in which several traditions had considered as Taqiyya. This study examines the ratio between the period of Shaikh and the period of earlier jurists before the fifth century and tries to find the main cause of the the reason for developing such a great individually by Shaikh. Whether this multiplicity of Taqiyya in Shaikh’s work is just because of the methodical difference between them, or it’s because of a serious fundamental difference between them. By this study, it will be proved that the difference between this two period isn’t just a methodical one and it is because of a deep fundamental difference.
