نگرشی تاریخی ـ تحلیلی به‌ مرجّحیت مخالفت با عامّه در متون فقه امامیه و تامّلاتی در آن

نوشتار پیش رو با رویکرد تاریخی ـ تحلیلی و با هدف طرح روایتی جامع از پیشینه و روند به‌کارگیری مخالفت با عامّه به عنوان مرجّح باب تعارض اخبار نوشته شده است در این اثر تلاش شده تا با واکاویدن سیر تاریخی موضوع، در خلال بررسی نوشته‌های بر جای مانده از فقه امامیه، از زمان نخستین کاربردها تا عصر حاضر، موقعیت آن نشان داده شود. درنگ در رویکردهای متفاوت پدیدآمده در مرجّحیت مخالفت با عامّه، شرایط و چگونگی اعمال آن در میان فقها و نیز فراز و فرودهای پدیدارشده در گذر تاریخ، نتایج تامّل‌برانگیزی را به بار نشانده است که از جمله می‎توان به اذعان به وجود رویکردهای سلبی و ایجابی نسبت به اصل موضوع، تغییر یافتن ادبیات موضوع پس از چند قرن، گزینش معیار تقیه در اخذ به این مرجّح و ادعای برقراری تلازم میان تقیه و مخالفت با عامّه از منظر اکثر فقها اشاره کرد. ضمن این‌که این مقاله، شماری از آسیب‎های ناشی از تحلیل غلط و درک نامناسب از حقیقت مخالفت با عامّه و شروط به‌کارگیری آن را نیز بررسی کرده است.

The Historic Analytic Regard to be Preferring of Disagreement with Sunni's in Texts of Shiite`s Jurisprudence and the Reflections on It.

The present paper has written with historical analytic approach and with goal of showing general narrative from history and procedure of utilization of disagreement with sunni`s as opposition of traditions’ preferring attribute; and has endeavored during it until be displayed its situation with analyzing of object`s historical process through study remnant records from shiite`s jurisprudence as long as initial usages until nowadays.Hesitation in different approaches that emerged in be preferring attribute of disagreement with sunni's, conditions and quality of its using among Jurists too ups and downs that appeared in Pass of history, brought the notable results that among them can be mentioned to acknowledging the existence of negative and positive approaches to origin of object, the alteration that occurred in object`s literature after several century, the selection of reservation`s criterion in usage of this preferring attribute and postulate of establishment of concomitance between reservation and disagreement with sunni's from the majority of jurists. Whilst this article has considered some of flaws originated from erroneous analysis and inappropriate percipience from principle of disagreement with sunni`s and conditions of its utilization.
