نقش عدالت در فرآیند استنباط اول و دوم

عدالت از کهن‌ترین مفاهیمی است که بشر با آن آشنا است و در زندگی روزمرّۀ او بسآمد چشمگیری دارد و در نصوص دینی به عنوان یکی از مقاصد اولیه انبیای الاهی از آن یاد شده است. این مفهوم، مفهومی پیشادینی است؛ اما نباید فارغ از نگاه به جهان، انسان و سرانجام وی، به تفسیر آن پرداخت. چنان‌که در تطبیق آن بر مصادیق و یافتن عینیت‌های آن، وقتی در یک نظام دیده می‌شود، باید عناصر موثـر در آن را ـ که در آن نظـام حضـور دارند ـ در نظر داشت. در بخش نظر و نظریه‌پردازی و اندیشه‌ورزی با مفهوم و مصداق‌شناسی عدالت، برخوردی بایسته نشده است؛ از این رو، لازم است کارایی‌های آن در کشف حکم باز‌خوانی شود تا اجرای عدالت بر بنیان آن صورت پذیرد. عدالت در فقه به مثابۀ یک سند، قاعده و روی‌کرد، حضور می‌یابد و به مثابۀ یک گفتمان عام در اجرای احکام مکشوف باید تحقق یابد.

The role of justice in the first and second inference process

Justice is one of the oldest concepts that humanity is familiar with it and is very common in his life and in religious texts; and it is known as one of the primary purposes of prophets. This concept is prereligious; but it should not be interpreted without looking at the world, man and his ending. So that in its confirmation with the applications and finding its identities, when it is considered in a system, its effective elements should be considered too which are present in the system. In terms of opinion and theorizing and thinking by the concept and meaning of justice, there is not appropriate treatment with it; Therefore it is necessary to review its implications in the detection of the rule, so the justice be enforced based it. Justice considered as a evidence, rule and approach in jurisprudence; and it must be realized as a general discourse in the implementation process of detected rules.
