گفتمان‌کاوی؛ رهیافتی نو در فقه جهاد از نگاه فقیهان و اندیشمندان مذاهب اسلامی

مطالعات گفتمانی، رویش و شکل‌گیری یک تفکر در بستر اجتماع و نحوهٔ اثرگذاری آن را تجزیه و تحلیل و از ورای آن به جهت‌بخشی اندیشه اقدام می‌کند. فقه به‌عنوان دانشی دیرین که در بستر اجتماع همواره برای مکلفان اثرگذار بوده است، با گفتمان‌های متعددی در درون و بیرون خود مواجه گردیده است. این امر در دنیای معاصر و ظهور رویکردهای فلسفی و عقلی به احکام فقهی جلوهٔ بیشتری یافته و گفتمان‌کاوی در فقه را با ضرورت مواجه ساخته است. در تحقیق پیش رو جهاد اسلامی به‌عنوان یک نهاد مهم فقهی که در قرن اخیر بیش از هر زمان با خوانش‌های متعدد روبرو است، انتخاب شده تا یکایک خوانش‌ها را که بر محور یک یا چند گفتمان معین شکل گرفته تحلیل کند و ریشه‌های شکل‌گیری هریک از خوانش‌ها را بازشناسد. این تحلیل به‌دلیل نگاه فرافقهی و فلسفی از جزئی‌نگری معاف بوده و در راستای رسیدن به خوانش صحیح از جهاد که مقتضای نیازهای زمان باشد، گام برداشته است. خوانش‌های مبتنی بر گفتمان‌های نص، دفاع، اختصاص، حقوق، قدرت، و مقاصد شریعت شناسایی و پس از تبیین مستقل باهم‌خوانی شده و در میان همه، خوانش مبتنی بر گفتمان مقاصدی مورد عنایت بیشتر واقع شده است.

discourse analysis; a new approach in the jurisprudence of jihad from the perspective of islamic scholars and thinkers

discourse studies analyze the emergence and formation of a thought within a society and how it influences the direction of ideas. islamic jurisprudence (fiqh), as an ancient science, has always impacted the lives of believers within society, and it has been confronted with numerous discourses both internally and externally. in the contemporary world, with the rise of philosophical and rational approaches to jurisprudential rulings, discourse analysis in jurisprudence has become essential. in this research, islamic jihad, as an important jurisprudential institution, which in the recent century has faced multiple interpretations, is selected. each interpretation, which is shaped around one or more specific discourses, is analyzed to uncover the roots of each interpretation. this analysis, due to its comprehensive and philosophical perspective, avoids being narrowly focused and aims to reach the correct interpretation of jihad that meets the needs of the time. interpretations based on the discourses of text, defense, exclusivity, rights, power, and the objectives of sharia are identified. after being independently explained, these interpretations are synthesized, with particular attention given to the interpretation based on the discourse of objectives.
