بررسی اجرای اصل عدم با شک در حالات مختلف کلمات به‌کار‌رفته در منابع فقهی

اگر نسبت به کیفیت (از قبیل مدّ، قصر، تشدید و تخفیف) کلمه‌ای شک داشته باشیم، با جریان اصل عدم می توانیم این کیفیت مخصوص را نفی کنیم. این اصل در عبارات تعدادی از فقها جاری شده، و نداشتن این کیفیتِ کلمه را نتیجه گرفته‌اند و در نگاه ابتدایی می‌توان ادعا کرد که جریان این اصل از مصادیق اصل عدم، مسلّم نزد فقها است، ولی علما این مبحث را مورد بحث و بررسی قرار نداده‌اند. ازآنجا‌که این بحث در فرآیند استنباط از اهمیت فراوانی برخوردار است، پژوهش حاضر با روش توصیفی-تحلیلی درصدد پاسخ به این سوال است که آیا جریان این اصل، حجت است یا خیر. ظاهر کلمات برخی علما مسلّم‌انگاشتن جریان آن است و ظاهر برخی دیگر انکار. با توجه به اینکه کیفیات کلمه با همدیگر متفاوت هستند و از یک قبیل نیستند، پس از مشخص‌ساختن مراد از جریان این اصل و بررسی هریک از احتمالات مطرح، این نتیجه به دست آمده که جریان اصالت عدم برای نفی کیفیات کلمه، از حجیت برخوردار نیست و نمی‌توان آن را در فرآیند استنباط قرار داد.

if there is doubt regarding the quality of a word (such as its length, shortening, emphasis, or reduction), the principle of non-existence can be applied to negate the specific quality. this principle has been applied in the expressions of some jurists, resulting in the conclusion that the quality of the word is absent. at first glance, it can be claimed that the application of this principle is a settled matter among the jurists, but scholars have not thoroughly examined this issue. since this topic is crucial in the process of jurisprudential inference, the current research aims to answer whether the application of this principle is valid or not. the apparent words of some scholars accept its application as a certainty, while others reject it. since the qualities of words are diverse and not of the same kind, after clarifying the meaning of applying this principle and examining the various possibilities, it was concluded that the principle of non-existence, in the context of negating the qualities of words, is not valid and cannot be considered in the inference process.
