بررسی تطبیقی امکان وقوع قتل با سحر از منظر فقه شیعه و اهل‌سنت

یکی از ابزارهایی که در سلب حیات انسان‌ها توسط یکدیگر مورد استفاده قرار می‌گیرد، افسون ساحران است. با توجه به غیراصابتی بودن سحر و مخفی‌بودن چگونگی تاثیرگذاری آن در سلب حیات، تضارب آرا و تشتت برداشت فقهای شیعه و اهل‌تسنن را شاهد است. گروهی، مستند به آیات قرآن، سنت نبوی و دلیل وجدانی، سحر را امر واقعی و در نتیجه قتل ناشی از آن را ممکن می‌دانند. در سوی مقابل، عده‌ای قائل به غیرواقعی‌بودن سحر هستند. اینها نیز مستند به آیات قرآن، سنت نبوی و دلیل وجدانی قائل به عدم‌امکان قتل به سحر هستند. پرسش این پژوهش، این است که آیا قتل ناشی از سحر امکان دارد یا خیر. بازخوانش نظریات فقیهان شیعه و اهل‌تسنن، به شیوهٔ تحلیلی-توصیفی، به این برآیند دست یازیده است که ادلهٔ منکران قتل ناشی از سحر، با نقد و رد مواجه بوده و در نتیجه ادعای قتل ناشی از سحر تقویت شده و قابل ‌قبول است.

a comparative study on the possibility of murder through magic from the perspective of shiite and sunni jurisprudence

one of the tools used in taking human life is magic. due to the non-corporeal nature of magic and its hidden impact on causing death, there is a divergence of opinions and varied interpretations among shiite and sunni scholars. some, based on quranic verses, the prophetic tradition, and intuitive reasoning, consider magic as a real phenomenon, and consequently, murder resulting from it as possible. on the other hand, others reject the reality of magic, also based on quranic verses, prophetic tradition, and intuitive reasoning, and deny the possibility of death caused by magic. the question of this research is whether murder caused by magic is possible. a re-examination of the views of shiite and sunni jurists, using a descriptive-analytical approach, concludes that the arguments against the possibility of murder caused by magic are refutable, thereby strengthening and making the claim of murder by magic acceptable.
