ضوابط تاثیر نیّت در ضمان

یکی از عناصر مهم که در عبادات و غیر آن بدان توجه می‌شود، عنصر قصد و نیّت است. بود یا نبود نیّت یا چگونگی یا تغییر منویّ می‌تواند در صحت و بطلان عبادت نقش‌آفرین باشد؛ چنان‌که در غیر عبادات نیز همین حالات می‌تواند آثاری وضعی در پی داشته باشد. ضمن اینکه در هر دو آثاری تکلیفی نیز در پی دارد. آنچه اکنون در نظر است، تاثیر نیّت در ثبوت ضمان است. هرچند این تاثیر ضابطه‌مند دانسته نشده است، با بررسی فروع فقهی و آرای فقیهان می‌توان ضوابطی را برای این تاثیر یافت. این ضواط گاه به مجرد نیّت ناظر است و گاه به نیّت توام با عمل ناظر است. دسته اول از قبیل دخالت قصد در تحقق عنوانِ رافع ضمان است که صرف بود یا نبود یا تغییر آن موجب ضمان و عدم ضمان است و دسته دوم از قبیل فقدان نیّت یا تغییر آن در عناوین قصدیه است که در پی آن رفتار انجام‌شده چهرۀ ضمان به خود می‌گیرد. تعیین سعه و ضیق قلمرو عناوین رافع ضمان یا ضمان‌ساز می‌تواند دلیل اصل تاثیر یا میزان این تاثیر قرار گیرد.

one of the important elements that is considered in worship and other things is the element of intention. the presence or absence of intention or the manner or change of the intention can play a role in the validity and invalidity of worship. as in non-worships, the same conditions can have some situational effects. in addition, in both, there are some obligatory effects. what is considered now is the effect of the intention in proving the guarantee. although this effect has not been considered to be normative, by examining the branches of jurisprudence and the opinions of jurists, we can find criteria for this effect. these criteria sometimes refer to the intention alone and sometimes refer to the intention combined with the action. the first category is the interference of the intention in the realization of the title of the guarantor, whether it was just or not or its change is the cause of guarantee and non-guarantee. the second category is such as the lack of intention or its change in the titles of intention, after which the performed behavior becomes a guarantee. determining the domain and titles of lack of guarantee can be the reason for the effect or the extent of this effect.
