واکاوی فقهی نگهداری از انواع سگ‌ها از منظر مذاهب اسلامی

سگ‌ها از هزاران سال پیش، همواره در امر شکار و نگهبانی در خدمت انسان‌ها بوده‌اند. در دنیای امروز نیز سگ‌ها علاوه بر خدمات پیش‌گفته، در اموری چون کشف مواد مخدر و مواد منفجره، یافتن زیرآوارماندگان، مسیریابی، تشخیص بیماری و ... نقش شایانی را ایفا می‌کنند. علاوه بر این برخی از افراد، سگ‌ها را به عنوان عضوی از خانوادۀ خود وارد محل زندگی خود کرده و بخشی از نیازهای عاطفی‌شان را توسط این حیوان تامین کرده و برخی از بیماری‌های روانی را با آن درمان می‌کنند. با وجود گسترش ارتباطات میان انسان و این حیوان، تا کنون تحقیق مستقلی در مورد حکم فقهی نگهداری از سگ‌ها ارائه نشده است. در نوشته حاضر که با روش توصیفی‌‌تحلیلی و با استفاده از داده‌های کتابخانه‌ای انجام شد، پس از بررسی ادلۀ‌ ارائه‌شده توسط فقیهان مذاهب گوناگون اسلامی این نتیجه به دست آمد که از جهت حکم اولی، نگهداری از تمامی انواع سگ‌های نافع جایز و نگهداری از سگ‌های غیرنافع بر خلاف نظر مشهور فقیهان که آن را حرام می‌دانند، مکروه است و از جهت حکم ثانوی عناوینی چون ایذاء، تشبه به کفار و خطرات بهداشتی می‌تواند حکم اولی را به حرمت یا کراهت مبدل سازد.

a jurisprudential analysis of keeping all kinds of dogs from the perspective of islamic denominations

dogs have always served humans in hunting and guarding since thousands of years ago. in today’s world, in addition to the aforementioned services, dogs play an important role in such things as discovering drugs and explosives, finding survivors, routing, diagnosing diseases, etc. in addition, some people bring dogs into their homes as a member of their family, provide part of their emotional needs with this animal, and treat some mental illnesses with them. despite the expansion of relationship between humans and this animal, so far no independent research has been provided on the jurisprudence of keeping dogs. in the present article, which was carried out with a descriptive-analytical method and using library data, this result was obtained after examining the arguments presented by the jurists of different islamic denominations that according to the first ruling, it is permissible to keep all kinds of useful dogs and keeping non-useful dogs is makrooh, contrary to the famous views of jurists who consider it haram, and in terms of the secondary ruling, titles such as harm, resemblance to infidels, and health hazards can turn the first ruling into haram or makrooh.
