نقش انواع پرداخت‌کننده‌های مالی در قماربودن بازی‌های رایانه‌ای

نوعی از بازی‌های رایانه‌ای دارای پرداخت‌هایی داخل بازی در صورت باختن یک طرف بازی است. شباهت برد و باخت در چنین بازی‌هایی با برد و باخت‌های قمار، زمینه سوال پیرامون قماربودن آنها شده و در تحقیقات فقهی مورد توجه قرار گرفته است، اما با توجه به تاثیرِ جهتِ پرداخت‌ها و انواع پرداخت‌کننده‌ها در قماربودن بازی‌ها، لازم است این پرداخت‌ها از این جهات بررسی شود. نقش جهت پرداخت‌ها در مقاله‌ای مستقل تحت‌عنوان «موضوع‌شناسی قمار در پرداخت‌های پس از باخت در بازی‌های رایانه‌ای» بررسی شده است، اما درباره نقش انواع پرداخت‌کننده‌ها با وجود تنوع آنها و تفاوت ماهیت و نقش آنها در قماربودن بازی‌های، پژوهشی مستقل که نقش پرداخت‌کننده‌ها را در چنین بازی‌هایی تبیین کند وجود ندارد. پژوهش حاضر درصدد پاسخ به مطالبات مهم بازی‌سازان اسلامی در ارائه ضوابط فقهی برای طراحی پرداخت‌کننده‌ها و پاسخ‌گویی به مطالبه بخش وسیعی از مسلمانان مصرف‌کننده بازی‌های رایانه‌ای به‌منظور پرهیز از قماری‌بودن بازی‌ها تدوین شده است. نتیجه تحقیق حاضر با مطالعه فقهی انواع پرداخت‌کننده‌ها و بررسی تحلیلی چهار قسم پرداخت‌کننده: 1. دو طرف بازی 2. یک طرف بازی 3. شخص ثالث 4. نرم‌افزار؛ تعیین قماری‌بودن نوع اول و برخی حالت‌های نوع چهارم با روش تطبیق عناصر رکنی قمار بر اقسام پرداخت‌کننده در بازی‌های رایانه‌ای است.

The Role of Different Types of Financial Payers in Computer Games as Being Gamble

There are some types of computer games with ingame payments if one side of the game loses. The similarity of winning and losing in such games with the wins and losses of gambling has raised the question of whether they are a gamble and has been considered in jurisprudential research. However, due to the influence of the direction of payments and the types of payers in the games as being gamble, it is necessary to examine these payments in these directions. The role of payments’ direction has been explored in a standalone paper entitled Thematic Gambling in PostLoss Payments in Computer Games. However, there is no independent study on the role of different types of payers, which explains the role of payers in such games, despite their diversity and differences in their nature and role in the games as being gamble. The current study seeks to respond to the important demands of Islamic game makers in providing jurisprudential criteria for the design of payers and respond to the demands of a large number of Muslims who use computer games in order to avoid gambling. The result of the present study, through a jurisprudential study of the types of payers and an analytical study of four types of payers is as follows: 1. both sides of the game 2. One side of the game 3. Third party 4. software. To determine whether the first type and some cases of the fourth type are gamble, a method of applying the elements of gambling to the types of payers in computer games can be used.
