شرطیت عقل، بلوغ و اسلام زوجین جهت تحقق احصان در حد زنا

تحقق احصان در حد زنا مستلزم آن است که فرد سابقاً با همسر خود نزدیکی کرده باشد. با وجود این زوجین باید در هنگام نزدیکی شرایطی را داشته باشند تا بتوان بر اساس آن حکم به مجازات رجم در صورت ارتکاب زنا از سوی ایشان صادر نمود. پیرامون شرایط مزبور اتفاق‌نظر وجود ندارد. به‌رغم اینکه ماده 226 قانون مجازات اسلامی مصوب 1392 عاقل و بالغ‌بودن شخص را در احصان زن و مرد لازم دانسته است و علاوه بر آن بلوغ همسر در هنگام نزدیکی را نیز در احصان مرد معتبر دانسته است؛ لکن نتایج پژوهش حاضر که به‌روش توصیفیتحلیلی انجام شده است، حکایت از آن دارد که هیچ دلیل متقنی بر اعتبار بلوغ و عقل حین نزدیکی به‌عنوان شرایط احصان وجود ندارد و بالغ و عاقل‌بودن شخص در زمان ارتکاب زنا کفایت می‌کند، هرچند نزدیکی وی با همسرش در زمان کودکی یا جنون صورت گرفته باشد. در نقطه مقابل، اسلام طرفین در شرایطی که دست‌کم یکی از زوجین مسلمان باشند، برای تحقق احصان ضروری است و ادله نقلی بر آن دلالت دارد. ازاین‌رو مقررات قانون مجازات اسلامی در این زمینه می‌بایست موردبازنگری قرار گیرد.

The Necessity of the Conditions of Reason, puberty and Couples’ Being Muslim to Realize Ihsan in Adultery Hadd

Realization of Ihsan (being married) in adultery hadd requires that the person has previously had sexual intercourse with his or her spouse. However, the couple must have the conditions during the intercourse so that they can be sentenced to (Rajm) stoning if they commit adultery. There is no consensus on these conditions. Despite the fact that Article 226 of the Islamic Penal Code adopted in 2013 considers the wisdom and maturity of a person necessary in Ihsan of a man and a woman, and in addition, the maturity of the spouse during the intercourse is valid in the ihsan of a man. However, the findings of the current study, which has been done by descriptiveanalytical method, indicate that there is no convincing evidence for the validity of maturity and wisdom during the intercourse as a condition of ihsan, and that a person is mature and wise at the time of committing adultery is enough, although the intercourse with his/her spouse has been occurred in childhood or insanity. On the other hand, the couple’s being Muslim is necessary for the fulfillment of ihsan in the case of at least one of them (the husband or wife) is Muslim and the narrated arguments is sufficient for that. Therefore, the provisions of the Islamic Penal Code in this regard should be reviewed.
