بررسی و تحلیل مبانی مشروعیت «ولی عرفی» در فقه

یکی از نهادهای پربسامد که در ابواب مختلف فقهی مورد توجه است، نهاد «ولایت» است. از میان مصادیق ولی، «ولی عرفی» کمتر مورد بحث و بررسی قرار گرفته است و علاوه بر ضرورت تبیین ماهیت، بررسی ادله مشروعیت ولایت آن نیز امری لازم است. بر این اساس پرسش اصلی پژوهش آن است که «مبانی مشروعیت ولی عرفی چیست؟» فرضیه پژوهش این است که اقارب نسبی (غیر پدر و جد پدری) اولیای عرفی هستند و برای مشروعیت ولایت آنها می‌توان از ادله نقلی و عقلی بهره جست. روش این پژوهش توصیفیتحلیلی است و ادله شرعی در آن مورد تحلیل و بررسی قرار می‌گیرد. یافته پژوهش حاضر آن است که می‌توان با تحلیل و موشکافی در ادله اولیه و ثانویه ولایت، ولیّ عرفی را به صورت مقید پذیرفت. پذیرش مشروعیت ولایت ولیّ عرفی، آثار فراوانی در زندگی فردی و اجتماعی خواهد داشت. علاوه بر آن می‌تواند بخشی از مسئولیت‌های حکومت و دستگاه قضایی را کاهش دهد و مدیریت امور، آسان‌تر و توسط خود مردم سامان پذیرد.

An Examination and Analysis of the Principles of Legitimacy of Customary Guardian in Jurisprudence

One of the most frequent institutions that is considered in various jurisprudential subjects is the institution of Wilayat (guardianship) . Among the examples of guardianship, customary guardianship has been less discussed and studied, and in addition to the need to explain the nature, it is necessary to examine the arguments for the legitimacy of its guardianship. Accordingly, the major question of the study is What are the principles of legitimacy of customary guardian?. The research hypothesis is that blood relatives (other than father and paternal grandfather) are the customary guardians and narrative and rational arguments can be used for the legitimacy of their guardianship. The method of this study is descriptiveanalytical and the religious arguments are analyzed in it. The finding of the current study suggests that by analyzing and scrutinizing the primary and secondary arguments of the guardian, the customary guardian can be accepted as a constrained guardian. Accepting the legitimacy of guardianship of a customary guardian will have many effects on individual and social life. In addition, it can reduce some of the responsibilities of the government and the judiciary system, and manage affairs more easily and by the people themselves.
