تبیین نظریه «لزوم مضاربه مدت‌دار» با تاکید بر فتواهای برخی از فقیهان معاصر

بنا به نظر مشهور فقیهان و قانون مدنی، مضاربه حتی با ذکر مدت، عقدی جایز است و هر زمانی که هریک از طرفین بخواهند، می‌توانند به‌طور یک‌جانبه عقد را فسخ نمایند. این نظر در مقام عمل مشکلاتی ایجاد می‌کند؛ ازاین‌رو، محققان برای رفع این مشکل راه‌حل‌هایی در نظر گرفته‌اند، ازقبیل شرط لزوم در ضمن عقد لازم دیگر یا شرط مدت در ضمن عقد لازم دیگر. در این بین، برخی از فقیهان معاصر راه‌حل بهتری در قالب نظریه‌ای جدید مطرح کرده‌اند. این مقاله در صدد تبیین این نظریه است. بر اساس این نظریه، مضاربه دو نوع است: مضاربه‌ای که مدت در آن ذکر می‌شود که عقدی لازم است و مضاربه‌ای که مطلق و بدون ذکر مدت است که عقدی جایز و قابل‌فسخ است. تحقیق پیش‌رو با گردآوری اطلاعات و داده‌ها ازطریق منابع نوشتاری و مکتوب، سامانه‌های رایانه‌ای و نرم‌افزارهای علمی با روش داده‌پردازیِ توصیفی تحلیلی صورت گرفته است. در این نوشته، پس از بیان تفصیلی اقوال و بررسی مفصل ادله، درستی و کارآمدی این نظریه نتیجه گرفته شده است.

Explaining the theory of "The Necessity of Timed Partnership" With an emphasis on Some Fatwas of Contemporary Jurists

According to the most of the jurists’ belief and civil law, partnership, even with determining time is a permissible contract and each of the sides can annul the contract any time they want onesided. This belief can cause problems in practice. Thus, researchers have found solutions for this problem including the necessary condition in other necessary contract or condition of time in other necessary contract. In the meantime, some of the contemporary jurists have come up with better solutions in the form of a new theory. The current paper tries to explain this theory. According to this theory, there are two types of partnerships: The partnership in which the time is determined and it is considered a necessary contract, and the partnership that is absolute and with determining the time which is considered a permissible contract and can be annulled. This study has been conducted by collecting data and information from written resources, computer websites, and scientific software through a descriptiveanalytical method. In this paper, the accuracy and efficiency of this theory is proven after explaining the viewpoints and examining the arguments in detail.
