تفسیر تکاملی معاهدات در حقوق بین‌الملل در پرتو قضیه اختلاف در خصوص کشتی‌رانی و حقوق مربوط به آن (کاستاریکا علیه نیکاراگوئه)

یکی از بغرنج ترین مسائل حقوق، ایجاد تعادل میان ثبات و گذر زمان است که یکی، نماد امنیت حقوقی و دیگری، نماد هماهنگی با مقتضیات روز و واقعیت های اجتماعی است. از سوی دیگر، یکی از مهم ترین مسائل حقوق بین الملل معاهدات، یعنی تفسیر تکاملی معاهدات بین المللی، با این موضوع مستقیماً مرتبط است؛ تفسیری که از یک­سو، قصد و اراده طرفین معاهده را مدنظر قرار می­دهد و از سوی دیگر، واقع‌بینانه، بر آن است که این قصد و اراده را با تغییرات اجتماعی حادث شده از زمان انعقاد پیمان، هماهنگ کند. قضیه اختلاف در خصوص کشتی رانی و حقوق مربوط به آن، یکی از آخرین رویه‌های دیوان بین المللی دادگستری است که تفسیر تکاملی در آن، بار دیگر به بحث گذاشته شد. این امر، واکنش حقوق دانان و محاکم بین المللی را در پی داشته است. نوشتار حاضر می کوشد مفهوم و جایگاه تفسیر تکاملی را در پرتو قضیه مذکور تحلیل کند.

Evolutive Interpretation of Treaties in International Law in the Light of Dispute Regarding Navigational and Related Rights Case (Costa Rica v. Nicaragua)

Creating a balance between the stability and the passage of time is one of the most complex legal issues, the first of which is the symbol of the legal Certainty and the latter is the symbol of harmony with the requirements of time and social realities. Furthermore, one of the most significant issues of the international law of treaties (i.e. evolutive interpretation of international treaties) is directly related to this subject matter the interpretation that on the one hand, considers the intention and the will of the parties to the treaty and on the other, realistically tries to harmonize this intention and the will with the created social changes since the conclusion of the treaty. Dispute regarding navigational and related rights case is one of the most recent precedents of the International Court of Justice wherein it has discussed the evolutive interpretation the matter that has brought a variety of commentaries from the lawyers and the international tribunals. This paper intends to analyze the concept and the position of the evolutive interpretation in the light of the aforementioned case.
