تاثیر انتصاب مکرر و نقش دوگانه داور و وکیل بر تنوع و ایجاد انحصار در داوری های بین المللی

ماهیت داوری‌ بین‌المللی و حاکمیت طرفین دعوا در انتخاب داور، ایجاب می‌کند داوران از میان افراد ذی‌صلاحی با ملیت، جنسیت و سنین گوناگون منصوب شوند. با این وجود بررسی‌ها نشان می‌دهد که داوری بین‌المللی عمدتا در انحصار مردانی سفیدپوست از کشورهای توسعه-یافته بوده و سایرین سهم چندانی در این عرصه ندارند. انتصاب مکرر برخی از داوران سرشناس و پذیرش نقش دوگانه داور و وکیل از مهمترین سازوکارهایی است که با دشوار ساختن ورود داوران جدید، موقعیت افراد موجود را تثبیت نموده و شبکه‌ی بسته‌ای از داوران بین المللی را شکل می‌دهد. مقاله‌ی حاضر با تحلیل تاثیر انتصاب مکرر داوران و پذیرش نقش دوگانه‌ی داور و وکیل بر تنوع جامعه داوری و متعاقبا بر کیفیت رسیدگی و مشروعیت داوری، پیشنهاد می‌کند که متعاقب افشای انتصاب‌ها و موضع‌گیری سابق داوران، در تعداد داوری و وکالتی که یک فرد می‌تواند بپذیرد، محدودیت ایجاد شود.

the effect of repeat appointment and double-hatting on diversity and formation of monopoly in international arbitrations

the nature of international arbitration and the party autonomy in the appointment of arbitrators require selection of the arbitrators from a diverse range of qualified persons, regardless of their nationality, gender and age. however, studies show that the international arbitration is mainly monopolized by white men from developed countries and others have little contribution. the repeated appointments of arbitrators and double-hatting are amongst the most important mechanisms worsening the existing situation, preventing the entry of newcomers and so leading to the formation of a closed circle of international arbitrators. by analyzing the effect of repeated appointments of arbitrators and double-hatting on the diversity of the arbitration community and subsequently on the integrity of proceedings and the legitimacy of arbitration, this article suggests that following the disclosure of the arbitrators’ previous appointments and positions, some limitation should be imposed on the number of appointments and cases one can get involved, either as an arbitrator or as a counsel.
