کاهش تهدیدات فضایی در پرتو حقوق نرم: مطالعه‌ موردی قطعنامه‌ 75/36 (2020) مجمع عمومی

امروزه عوامل متعددی دارایی‌های فضایی را تهدید می‌کنند که مسلح شدن فضای ماورای جو، یکی از مهم‌ترین این عوامل است. ازاین‌رو پیشگیری از تسلیحاتی شدن فضا برای دولت‌ها از اولویت بسزایی برخوردار است. در این راستا طی دهه‌های اخیر تلاش‌های متعددی در دو بُعد حقوق سخت و حقوق نرم صورت گرفته است که اغلب با شکست روبه‌رو بوده‌اند. با وجود این، در سال‌های اخیر، گرایش به حقوق نرم برای پیشگیری یا کاهش تهدیدات فضایی در بین دولت‌ها افزایش یافته است. قطعنامه‌ 75.36 (2020) با عنوان «کاهش تهدیدات فضایی از طریق هنجارها، قواعد و اصول رفتار مسئولانه»، یکی از آخرین قطعنامه‌های مجمع عمومی سازمان ملل متحد در این خصوص است که از مقبولیت بالایی در بین دولت‌ها برخوردار شده است. این قطعنامه از آن جهت اهمیت دارد که برخلاف قطعنامه‌های پیشین در این زمینه، بر «رفتار» دولت‌ها تاکید دارد. این نوشتار در صدد پاسخگویی به این پرسش است که قطعنامه‌ یادشده به‌عنوان مصداقی از حقوق نرم، چگونه در کاهش تهدید دارایی‌های فضایی موثر است.

reducing space threats in the light of soft law: a case study of general assembly resolution 75/36 (2020) (original research)

today, several factors threaten space assets, and the weaponisation of outer space is among the most important ones. therefore, preventing the weaponisation of space is of high priority to states. in this regard, there have been many efforts in the two dimensions of hard law and soft law during the last decades, which have often faced failure. however, in recent years, the trend towards soft law to prevent or reduce space threats has increased among states. resolution 75/36 (2020) entitled &reducing space threats through norms, rules and principles of responsible behavior& is one of the latest resolutions of the united nations general assembly concerning this issue, which has been highly accepted by states. this resolution is of importance because, unlike previous resolutions, it emphasizes the &behaviour& of states. this article tries to answer the question of how the mentioned resolution as an example of soft law is effective in reducing the threat of space assets.
