حمایت از نهنگ ها در برابر آلودگی های صوتی به موجب حقوق بین الملل محیط‌زیست دریایی

آلودگی صوتی دریایی، تهدیدی علیه جانداران دریایی و ازجمله پستانداران دریایی نظیر خانوادۀ نهنگ ها تلقی می شود. میزان رو به افزایش صداهای مزاحم در محیط‌زیست دریایی می تواند تاثیرات عمده و چه بسا کشنده بر ستاسه ها داشته باشد. مطالعات نشان می دهد که کاهش تنوع گونه ای میان نهنگ ها و دلفین ها ارتباط مستقیم با افزایش صداهای مزاحم در زیر دریا دارد. مقالۀ حاضر به دنبال یافتن مبانی حقوقی لازم در حقوق بین الملل محیط‌زیست دریایی به منظور حفاظت از نهنگ ها در برابر تاثیرات منفی ناشی از آلودگی صوتی است؛ لذا سوال اصلی مقاله عبارت است از اینکه مبانی هنجاری و فعالیت های سازمانی ذیل حقوق بین الملل محیط‌زیست تا چه میزان در حمایت از نهنگ ها در برابر آلودگی صوتی نقش داشته اند؟ در خصوص سوال مزبور، این فرضیه مطرح می شود که اسناد اصلی محیط زیستی یا دریایی بین المللی مقررات صریحی راجع به آلودگی صوتی ندارند، اما برخی از آنان چارچوب های لازم و اولیه را برای پرداختن به موضوع دارند و می توانند با تفسیر نسبت به مسئلۀ آلودگی صوتی اعمال شوند. به‌علاوه، شماری از سازمان های بین المللی نیز انجام فعالیت ها و برنامه هایی خاص در راستای بهبود حمایت از جمعیت نهنگ ها در برابر آلودگی صوتی را در دستور کار دارند.

protecting the whales against acoustic pollution under the international marine environmental law

underwater noise pollution is considered a threat to marine biodiversity and marine mammals, such as whale species. an increasing amount of disturbing noise in the marine environment can have major and even fatal impacts on the cetaceans. studies have shown that decreased species diversity in whales and dolphins is directly related to an increase in underwater noise. the present article seeks to find the legal basis in international marine environmental law to protect whales against the adverse impact of acoustic pollution. therefore, the article’s main question is to what extent the normative foundations and organizational measures under international environmental law play a role in protecting whales against noise pollution. studies show that main international environmental or marine instruments contain no explicit provisions about acoustic pollution. however, some have the necessary framework to address the issue and can be applied through interpretation. in addition, several international organizations have acted toward protecting the population of whales against noise pollution.
