قانون به مثابه امری اجتماعی؛ مطالعه روش شناسانه نظریه قانون مونتسکیومجتبی جاویدی

با پیدایش مدرنیته به تدریج شاهد تغییر مبنای علم و شکل‌گیری علمی متفاوت از دوران پیش از آن هستیم. علم جدید، صورت کامل شده علم دوران پیش از مدرن نیست، بلکه مبتنی بر بنیادهای هستی‌شناسانه، معرفت‌شناسانه و انسان‌شناسانه متفاوت و متکی بر تلقی خاصی از طبیعت، انسان و خداوند است. نظریه مونتسکیو در چارچوب رویکرد مدرن، توجهی به طبیعت ثابت انسان، مبدا و غایت وجودی او در رسیدن به سعادت حقیقی ندارد. در چارچوب آن، انسان دارای طبیعتی ثابت و پایدار نیست، بلکه طبیعت او در خلال اجتماع ساخته می‌شود. او قانون را از اجزای نظام اندام‌واره اجتماعی می‌داند و تلاش می‌کند پیوند بین «قانون» به عنوان امری اجتماعی با شرایط مختلف اجتماعی را آشکار سازد. مهم‌ترین نتایج تلقی قانون به مثابه امری اجتماعی در اندیشه مونتسکیو عبارت است از: تحلیل قوانین جامعه بر اساس شرایط اجتماعی، پذیرش روابط علّی حاکم بر قانون، نسبیت قانون و جدایی آن از ارزش‌ها و از دین. این مقاله می‌کوشد با رویکرد روش‌شناسانه، بین اصول علم اجتماعی او و مبانی بنیادین آن و نظریه قانون وی ارتباط برقرار کرده و نظریه قانون او را در پرتو بنیان‌های علم اجتماعی جدید که متفاوت از بنیان‌های علم سنتی است مورد مطالعه نمایید.

with modernity’s advent, we are witnessing changes in the basis of scienceand forming a different one from the previous era gradually. the newscience is not the complete form of the science of the pre-modern era but it isbased on different ontological, epistemological, and anthropologicalfoundations based on a specific perception of nature, men, and god.montesquieu's theory does not pay attention to the permanent nature of men,their origin, and their true purpose for reaching happiness in the modernapproach’s framework. in this framework, men don’t have a permanent andstable nature, but their nature will be created in society. montesquieuconsiders the law as one part of the social system and tries to reveal theconnection between law as a social matter and different social conditions.the most important results of considering law as a social matter inmontesquieu's thought are: analyzing of laws of society based on socialconditions, acceptance of causal relations on law, relations of law, and itsseparation from values and religion. this article tries to make a connectionbetween his social science principles, his basic principles, and his law theorywith a methodological approach and studies his law theory based on thefoundations of new social science, which is different from traditionalscience.
