توسعه اصل پیشگیری در نظام حقوقی تغییرات اقلیم

در سال‌های اخیر، مقررات راجع به تغییرات اقلیم با رویکردی بازدارنده در سطح بین‌المللی منعکس شده است. این رویکرد، در حقوق بین‌الملل محیط‌زیست‌ در قالب یک اصل تحت عنوان اصل پیشگیری مطرح می‌گردد که به معنای پیشگیری از صدمات و خسارات زیست‌محیطی، پیش از وقوع آنها است. با توجه به اهمیت موضوع، در این تحقیق تلاش می‌گردد از طریق بررسی اسناد بین‌المللی حاکم بر رژیم حقوقی تغییرات اقلیم، تعهدات دولت‌ها در پیشگیری از این تغییرات، مورد تجزیه و تحلیل قرار بگیرد. بنابراین، سعی شده با تکیه بر کنوانسیون ساختاری سازمان ملل درباره تغییرات آب و هوایی، پروتکل کیوتو و همچنین ‌توافق‌نامه پاریس به جمع‎بندی آخرین دستاوردهای حقوق بین‌الملل به ویژه رویکرد دیوان بین‌المللی دادگستری و کمیسیون حقوق بین‌الملل پرداخته شود./p>پژوهش حاضر بر اساس مطالعات کتابخانه‌ای و به روش توصیفی- تحلیلی و بر اساس یافته‌های مروری نگارش گردیده است.بدون شک تغییرات اقلیم، یک چالش و مساله زیست‌محیطی جهانی و فرامرزی محسوب می‌گردد. در رژیم حقوقی مرتبط با آن می‌توان رویکرد پیشگیرانه‎ای را در کالبد تعهدات کاهش و مقابله با تغییرات اقلیم و اثرات ناشی از آن، درک نمود.رژیم حقوقی تغییرات اقلیم، تعهدات دولت‌ها را با محوریت اصل پیشگیری مقرر داشته ‌است. این موضوع حاکی از توجه و درک جامعه بین‌المللی بر اهمیت اتخاذ اقدامات پیشگیرانه است. لزوم ضمانت اجرا درایفای تعهدات اقلیمی نیز کارآمدی رویکردهای پیشگیرانه را تضمین می‌نماید.
