بررسی حقوقی - زیست محیطی تاثیرات فعالیتهای انسانی با رویکرد معدنکاوی در بستر دریاها

زمینه هدف : مواد معدنی موجود در طبیعت از ارزشمندترین ثروتهای زمین می باشندکه با توجه به محدودیت این منابع در خشکی و پراکندگی ناهمگون  ان در کشورهای مختلف ، همواره بین دول مختلف در عرصه جهانی بر سر کسب و بهره برداری از این منابع رقابت وجود داشته  است . چرا که چرخهای اقتصاد و تولید وابسته به تامین منابع اولیه می باشد . با توجه به محدودیت منابع خشکی و پیش بینی برای اتمام کلیه ذخایر و ظرفیتهای موجود ، منابع معدنی بستر اعماق دریا می تواند به عنوان جایگزینی مطمئن در جهت جبران محدودیتهای منابع خشکی مطرح شود.روش بررسی : تحقیق حاضر با استفاده از روش تحلیلی ، توصیفی به بررسی مباحث عمده ای در خصوص کاوش و بهره برداری منابع مختلف طبیعی از بستر دریاها و  قوانین حاکم بر این بخش و شرایط بهره برداری آنها می پردازد .یافته ها :  یافته های  تحقیق حاکی از آن است که با توجه به اکوسیستم حساس و آسیب پذیر مناطق دریایی بویژه در بستر و زیر بستر دریاها و فقدان دانش لازم جهت انجام فرآیندهای استخراج در این مناطق ، خلاهای حقوقی و اجرایی در این حوزه احساس می شود.بحث و نتیجه گیری : بازنگری در مقررات و قوانین حقوق بین الملل بویژه حقوق بین الملل محیط زیست و انجام راهکارهایی نوین ، در فرآیند اکتشاف و معدنکاری  با الزامات مربوط به توسعه پایدار و بهره برداری منطبق با شرایط و توان اکولوژیکی این زیستگاهها ، از عمده ترین نتایج این پزوهش بوده که در این خصوص چندین راهکار و پیشنهاد نیز ارائه گردیده است .

Legal-environmental study of human activities impacts with a mining approach in the seabed

Background: Despite the limitation of natural resources on earth and the inharmonious spreading of these treasures, the world meets an ongoing tournament beyond different territories to get benefits in such a way to exploit more and more. Due to the limited land resources and the forecast for the depletion of all available reserves and capacities, deep-sea mineral resources can be considered as a reliable alternative to compensate for the land resources limitations.Studying Method: This study, using an analytical descriptive method, studies the major issues regarding the exploration and exploitation of various natural resources from the seabed and the laws governing this sector and their exploitation conditions.Findings: The research indicates that due to the sensitive and vulnerable ecosystem of marine areas, especially in the seabed and sub-seabed and the lack of knowledge necessary to carry out extraction processes in these areas, legal and executive gaps are felt in this area.Conclusion Results: It is necessary to review the rules and regulations of international law, especially international environmental law, and implement new solutions, the process of exploration and mining with the requirements of sustainable development and exploitation in accordance with the ecological conditions and potential of these habitats.
